That fact is that the servers and email accounts were operated by the Federal government and not the separate private legal entity known as the Presidents Transition Team.


So, show how about showing the law that says that Federal law enforcement can't have access to government emails on government servers and for government accounts?

Here is the link to the USC, now show us the law enacted as part of the Presidential Transition Act of 1963 (when there was no email), that email accounts owned and operated by the US Government (GSA is a federal agency and is the owner of the accounts and servers) is not available to Federal law enforcement (which as a DOJ Special Counsel Mueller is) as part of criminal investigations.

The Presidential Transition Act states that all records of transition operations are private and confidential.

Yet Mueller seems to have ignored the law. Without a warrant or subpoena, his team of lawyers brazenly demanded these private records from the General Services Administration (GSA) which held custody of the materials. The GSA does this as a service to all incoming presidents out of courtesy, but it neither owns the documents nor is authorized to release them to anyone under any circumstances because they are deemed entirely private.

Jarrett says the most damning charge against Mueller is that he obtained, reviewed and used material that is privileged.

"Courts have clearly stated what prosecutors are supposed to do under these circumstances: “An attorney who receives privileged documents has an ethical duty to cease review of the documents, notify the privilege holder, and return the documents.” (U.S. v. Taylor 764 Fed Sup 2nd, 230, 235)

If all this is true, it is a tough political situation for Trump. On the one hand, he has grounds to remove and even prosecute Mueller, but on the other hand that action would be characterized by political enemies as firing the man who is investigating his “dirty” deeds. Best outcome for Trump is to allow Mueller complete his investigation, and assuming he is innocent, have Mueller make that determination.

He has no grounds to remove and prosecute Mueller. If he did then he should be removed. What Mueller is likely to find was that there was no coordination however the Trump campaign was willing to accept help no matter where it came from. Trump was too lazy to be in it.

There is no evidence that Coney and Mueller were friends. Being colleagues doers not make you a friend. Justice Department guidelines do allow DOJ employees to contribute to political campaigns. They have a certain expertise that Mueller needs and that is all. They are not making the final decision on who to prosecute.

Even if the emails were improperly obtained, the best Trump could get his having those records deleted and could not be used in the investigation.
