Going to be interesting. I am very curious as to the horsetrading going on in the court. Anthony Kennedy, based on his past rulings, will probably agree to strike down the mandate but not the bill as a whole.

So, what will Obama do after his win?

Depends on if the Dems re-take the House. If they do, I see Obama and the Dems trying again and possibly bringing back the Public Option. If the GOP keeps the House, they will never allow a vote on anything for health care reform, so there would be no point in Obama trying anything.



So, he's not going to do anything on healthcare. Check.

What will he do?

Gonna be interesting to have a president who has been chastened for unconstitutional activities once and who has generated a queue of other cases waiting to see just how many more of his actions are going to be reversed - such as his violation of Article I of the constitution when he unilaterally declared the Senate out of session and all the fallout there will be when the SCOTUS rules on that. Luckily, when ACA is struck down that should resolve the birth control mandate issue but that's just part of the judicial log jam Obama has caused.

What will stop four more years of Obama from being four more years of national paralysis.

For someone who cries about liberty on a daily basis, you certainly don't care if people actualy have.any or not.

The Federal Government has NO authority granting it the power to declare what a private citizen must buy from a private firm. The Commerce clause does not grant such authority and in fact I would argue is designed to prevent it.

Further the Government can not claim it is a tax because those have to be uniform through out the Country and they have no authority to tax to pay private firms.

But the Government did try and argue that it was both a tax and not a tax.
 
I'm still waiting for people to show how the law is constitutional, where in the constitution is the power given? The first attacks on this thread from Obamacare supporters were that the SC is basically legislating from the bench by not upholding Obamacare... So, where is Obamacare legal under our constitution?

This is important because if Obama really believed in his HC bill why didn’t he amend the constitution so there was no issue later like anyone that has read the constitution knew there would be. I thought Obama studied the constitution…

I honestly doubt he understands the question. After Obamacare if there was a mandate passed that everyone must buy a home so there are no homeless people DBS would prolly support it as long as Obama or a Democrat President wanted it. If DBS would not agree that everyone should buy a home then my question is on what grounds would DBT argue the Government can't do that, or would he just really really really hope they don't pass such a stupid law now that the restraint of the constitution no longer applies to the Congress/President?
