Israeli politician Tzipi Livni 'summoned by UK police'

Israeli politician Tzipi Livni was summoned by UK police for questioning over alleged war crimes while in London last week, Israeli officials have said.

Ms Livni received a letter from the police on Thursday but the summons was cancelled after talks between Israel and the UK, Israeli media reports say.

Urgent diplomatic contacts were made between the two countries, which resulted in Ms Livni being given diplomatic immunity and declining the invitation to questioning

She Shit herself, if you've got nothing to hide, there is nothing to fear, she knows war crime's were committed, when she gave the order to "Go Wild" Thats why she refused to talk to the Police

Under international law, genocide, crimes against humanity and war crimes are usually not subject to the statute of limitations as codified in a number of multilateral treaties. States ratifying the Convention on the Non-Applicability of Statutory Limitations to War Crimes and Crimes Against Humanity agree to disallow limitations claims for these crimes. In Article 29 of the Rome Statute of the International Criminal Court, genocide, crimes against humanity and war crimes "shall not be subject to any statute of limitations".

There is no outstanding warrant for any Israeli Government Official. No crime within the scope of UK Law has been committed.

The ICC Prosecutor has not agreed to any prosecution on any level.

This is just some sort of grandstanding. It happens periodically. There is no reason for the UK to step outside its authority on matter of international law.

The questioning would have focused on violations of the Geneva Convention committed by Israeli forces during Operation Cast Lead that began in December 2008.
No international law enforcement or investigative organization, including the ICC, has establish any criteria for international crime. A preliminary examination is conducted to decide whether there is enough information on crimes of sufficient gravity, providing a reasonable basis to open an investigation. This is similar to "probable cause."

• Current Status of "Preliminary" Investigation:

The UK Police are notorious for grandstanding and media hogging.

Why would a diplomat be talking to a local police officer about ANYTHING? Maybe that's how things go down in your Muslim shithole. In civilized nations diplomats don't respond to bullshit summons inspired by Mooslems.

And this was not a state summons as you think, but a unique to the UK private civil matter. The Palestinian group that instigated it did so against unnamed Israeli politicians as a means to generate propaganda. The court can not hand down any prison sentences and is restricted in just what punishment it can issue. The UK changed the law shortly after the last fiasco, but as I keep explaining laws can not be used retrospectively so any summons on the books is still valid.

Care to produce a link to your claims that are LIBELOUS and RACIST that she gave the order to go wild.

Failure to do so shows that you are once again LYING and inciting violence against the Jews, and as such would face a prison term if you ever entered Europe under the above laws

fanger, et al,

Well, this is not a question, properly framed.

• Is sovereign or diplomatic immunity available to government officials where they are charged with either war crimes, crimes against humanity or genocide?

Diplomats do not have immunity from War crimes
(COMMENT)

All diplomatic immunity temporary in nature and stems from the host nation recognizing and granting a special status (or derivative special status) to a foreign diplomat or government official. In the case of the UK, Minister Tzipi Livni sends her "Diplomatic Passport" to the UK Embassy in Tel Aviv, and the UK government (Foreign Office) puts a fancy little VISA in the Passport citing the special status. And this is what protects Diplomats and Government Officials from arrest and prosecution.

This is in keeping with Article 31 of the Vienna Convention on Diplomatic Relations 1961 protecting diplomatic agents from criminal prosecution such that the Convention provides ‘a diplomatic agent shall enjoy immunity from the criminal jurisdiction of the receiving State.

Article 31
1. A diplomatic agent shall enjoy immunity from the criminal jurisdiction of the receiving State. He shall also enjoy immunity from its civil and administrative jurisdiction, except in the case of:

(a) A real action relating to private immovable property situated in the territory of the receiving State, unless he holds it on behalf of the sending State for the purposes of the mission;
(b) An action relating to succession in which the diplomatic agent is involved as executor, administrator, heir or legatee as a private person and not on behalf of the sending State;
(c) An action relating to any professional or commercial activity exercised by the diplomatic agent in the receiving State outside his official functions.

Now, understand that the special status from which the diplomatic immunity arises, ends once the Diplomats and Government Officials leave their official posting. This is the common interpretation of:

Article 39(2)
2.When the functions of a person enjoying privileges and immunities have come to an end, such privileges and immunities shall normally cease at the moment when he leaves the country, or on expiry of a reasonable period in which to do so, but shall subsist until that time, even in case of armed conflict. However, with respect to acts performed by such a person in the exercise of his functions as a member of the mission, immunity shall continue to subsist.

Generally speaking, then once the issue of "immunity" is settled, then the International Criminal Court (ICC) must determine if Jurisdiction criteria is met. The ICC could exercise jurisdiction over such crimes committed by anyone on Palestinian territory. Israel, like the United States, is not a an ICC member, but its citizens could be tried on accusations of crimes on Palestinian land. But there is a question if the ICC has jurisdiction over allegations 13 June 2014, when the State of Palestine's ratification did not go into force until 1 April 2015 (the following year).

Article 12 Preconditions to the exercise of jurisdiction

1. A State which becomes a Party to this Statute thereby accepts the jurisdiction of the Court with respect to the crimes referred to in article 5.

2. In the case of article 13, paragraph (a) or (c), the Court may exercise its jurisdiction if one or more of the following States are Parties to this Statute or have accepted the jurisdiction of the Court in accordance with paragraph 3:

  • (a) The State on the territory of which the conduct in question occurred or, if the crime was committed on board a vessel or aircraft, the State of registration of that vessel or aircraft;

    (b) The State of which the person accused of the crime is a national.
3. If the acceptance of a State which is not a Party to this Statute is required under paragraph 2, that State may, by declaration lodged with the Registrar, accept the exercise of jurisdiction by the Court with respect to the crime in question. The accepting State shall cooperate with the Court without any delay or exception in accordance with Part 9.
Article 13Exercise of jurisdiction

The Court may exercise its jurisdiction with respect to a crime referred to in article 5 in accordance with the provisions of this Statute if:

  • (a) A situation in which one or more of such crimes appears to have been committed is referred to the Prosecutor by a State Party in accordance with article 14;

    (b) A situation in which one or more of such crimes appears to have been committed is referred to the Prosecutor by the Security Council acting under Chapter VII of the Charter of the United Nations; or

    (c) The Prosecutor has initiated an investigation in respect of such a crime in accordance with article 15.
If the questions were simple enough for the laypersons in this discussion group to answer, cut'n'dry, then the preliminary investigation would be well over. At the current time, the State of Palestine is desperately trying to gain the sympathy of the court through politicization, on totally separate issues not directly answerable. The State of Palestine is not trying to address any of the questions leading up to the confrontation. The State of Palestine simply starts the fight, provoking a military response, and then file for the court to address how hard the State of Israel hit back.

And who has said she has committed war crimes ? Because Britain hasn't no matter how you twist the words in your link.

The only "diplomats" accused of war crimes just so happen to be islamonazi's, and they laughed at the ICC/ICJ until they realised they faced summary arrest if they set foot outside of their country. They gave themselves up and agreed to face the International courts and recieved a lenient sentence.

Now where is the link to the only authority that can issue an arrest warrant for war crimes in the case of this Israeli politicain, or is this another of your LIES and BLOOD LIBELS

If you look at the likes of fanger and their posts you will see that then do not want the geneva conventions, international laws and the UN resolutions to work in favour of the Jews. When it looks like the Jews could be on a winning streak the same old tired links to libels and lies are trotted out in afutile attempt at making the Jews look bad. Time to enforce international arreast warrants for anti semitism and holocaust denial and start arresting muslims the world over for breaking these laws. Lets hope fanger and sunni troll are amongst the first to be dealt with

Ms Livni declared yesterday that the military offensive had "restored Israel's deterrence ... Hamas now understands that when you fire on its citizens it responds by going wild – and this is a good thing." Israeli cabinet divided over fresh Gaza surge

Which is usually the result of a axt of war against children. The palestinians know that they face the full force of the Israel military machine and they are not able to withstand it. They have the answer in their hands and refuse to act on it.

Muslims falsely accuse others of "war crimes" when in reality they're the ones guilty of it. Let us keep in mind that Hamas has been designated a terrorist organization by the US, Europe, and civilized nations.

As many NGO's have stated every illegal weapon fired from gaza and the west bank is now not only an act of war but a war crime. So why wont the UN act and arrest the palestinians responcible, starting with those in Washington at the UN

Phoenall, Roudy, fanger, et al,

This is on the cusp of several adverse facets that now, bring to the forefront:

• The validity and value of the UN.
• The UN should perform its duties and arrange international affairs so that world-wide confidence and trust in the integrity, objectivity and impartiality of the General Assembly is conserved and enhanced.
• Politicalization of the legal and ethical processes for partisan advantage.

The need to reassess the organizational framework of the UN has never been greater.

“Unfortunately . . . Israel [has] suffered from bias—and sometimes even discrimination” at the United Nations, said none other than the UN’s highest official, Secretary General Ban Ki-moon, speaking in Jerusalem in August.
The UN, relative to the Arab-Israeli conflict has been, in many respects, exhibiting the symptoms of Stockholm Syndrome. Groups like the UN Relief and Works Agency (UNRWA) find themselves justifying their actions in order to maintain a working environment. It is why, for instance the UNRWA only mildly scolded HAMAS for storing rockets on UN school property; yet turn right around and return them to HAMAS. Why? Because the UNRWA wants to desperately maintain the prerequisite relationship in order to carry-out their mission.

The UN’s Human Rights Council (UNHRC) has issued more condemnations of Israel than of all other countries combined; Israel was condemned 61 times by the UNHCR, while there were only 55 condemnations issued to all the other countries combined.

While the "Cultural Revolution in China" took over a million lives (1966-1976), the seven decades of the Arab-Israeli conflict only involved less than 30,000 casualties. Whether we talk about the Annexation of Tibet, or the Annexation of the Crimea, the approach in which the the Israeli Occupation is over exaggerated is extraordinary.

Correct, UN is the world's most political organization, and since most of today's world govt.'s are controled by delusional leftists, fascists, and Islamists who use the leftists as useful idiots in achieving their antisemtic goals, tiny Israel becomes a very convenient and easy target for them. Heck, even Israel has quite a few of these leftist morons, who guess what, like the US are very influential in academia and as media personalities.
