Releasing the report on Monday, Ban condemned the attacks “as a matter of the utmost gravity” and said “those who looked to them for protection and who sought and were granted shelter there had their hopes and trust denied”.

Ban insisted that UN locations were “inviolable”.

The issue is particularly sensitive as the locations of all UN buildings – including schools used as shelters – are routinely provided to the Israeli military and updated in times of conflict.

Ban’s criticism was contained in the published summary letter of a confidential internal report, commissioned by the secretary general in November, running to 207 pages.

Subsequently, and in accordance with the MAG's investigation policy, the incident was referred to the FFAM.


The factual findings and materials collated by the FFAM and presented to the MAG, indicated the existence of grounds for a reasonable suspicion that the strike was not carried out in accordance with the rules and procedures applicable to IDF forces. As a result, the MAG has ordered a criminal investigation into the incident.


2.Allegation Concerning Civilian Casualties Resulting From a Strike in the Vicinity of an UNRWA School in Beit Hanoun (24 July 2014)[published in a press release dated September 10th, 2014]


The MAG Corps received reports, as well as complaints from UNRWA and from human rights organizations, regarding allegations that an IDF strike in the vicinity of an UNRWA school in Beit Hanoun on July 24, 2014, resulted in the death of 15 civilians. Subsequently, and in accordance with the MAG's investigation policy, the incident was referred to the FFAM.


The factual findings and materials collated by the FFAM and presented to the MAG, indicated the existence of grounds for a reasonable suspicion that the incident involved a deviation from the rules and procedures applicable to IDF forces. As a result, and despite the fact that the actual number of civilian casualties is as yet unknown, the MAG has ordered a criminal investigation into the incident.

And both were investigated and found to be unfounded. The beach incident had too many discrepancies in the evidence submitted by hamas, and pointed to an earlier incident that was a hamas/fatah killing. The school was not targeted but two terrorists were and the munitions used killed the two terrorists but did not harm any one else. The bodies were shipped in or were posed by actors in the usual hamas propaganda fashion.

The evidence is slim at the very least and so should have been ignored after the finding of hamas qassam rockets in UNWRA schools. The video and satellite imagery should have been taken into account of just where rockets and mortars were fired from and those areas designated by the UN as valid military targets

I believe it is around page 20 of the document that discusses the illegal use by hamas and the UN responsibility of removing and relocating those taking shelter with the UN away from those buildings.
Weapon storage or firing from or near UN buildings make them legitimate targets. Civilians were not intentionally being targeted.

In the incidents investigated at least 44 people were killed and 227 injured including women and children. In none of the schools which were hit directly or in the immediate vicinity, were weapons discovered or fired from. If it were confirmed that militants did fire rockets from our schools we would condemn it, just as we robustly we condemned other violations of our neutrality.”
