Not under current International law, as Israel not being a signatory to the Rome statute is not bound by it. But Palestine having signed to it are. So this means that any inkling of war crimes by hamas will have the UN members who are Israel's friends baying for blood and demanding that arrest warrants be issued for their arrests on charges of war crimes. The shit will then hit the fan and no amount of posturing by ISLAMONAZI PROPAGANDISTS will be able to change the reality that Israel tried to save the Palestinian leadership from facing life in prison. Israel has ratified the main human rights conventions; however, it is not a party to any additional protocols except the Optional Protocol on Children in Armed Conflicts. It has also not accepted the jurisdiction of any of the treaty body committees; thus, individual communications cannot be considered. In addition, Israel made important reservations on the conventions it ratified.

Israel is a party to the 1949 Geneva Conventions, but not to the first and second 1977 Additional Protocols. Although Israel has signed the 1998 Rome Statute on 28 August 2002, the Secretary-General received from the Government of Israel, the following communication: "...in connection with the Rome Statute of the International Criminal Court adopted on 17 July 1998, [...] Israel does not intend to become a party to the treaty. Accordingly, Israel has no legal obligations arising from its signature on 31 December 2000. Israel requests that its intention not to become a party, as expressed in this letter, be reflected in the depositary's status lists relating to this treaty."

Israel has domestically declared State of Emergency since 1948. A notifications under Article 4(3) of the Covenant on Civil and Political Rights (Derogations), was made on 3 October 1991, after the ratification of the Convention.

"Since its establishment, the state of Israel has been the victim of continuous threats and attacks on its very existence as well as on the life and property of its citizens. These have taken the form of threats of war, of actual armed attacks, and campaigns of terrorism resulting in the murder of and injury to human beings. In view of the above, the State of Emergency which was proclaimed in May 1948 has remained in force ever since. This situation constitutes a public emergency within the meaning of article 4 (1) of the Covenant. The Government of Israel has therefore found it necessary, in accordance with the said article 4, to take measures to the extent strictly required by the exigencies of the situation, for the defence of the state and for the protection of life and property, including the exercise of powers of arrest and detention. In so far as any of these measures are inconsistent with article 9 of the Covenant, Israel thereby derogates from its obligations under that provision."




Which means that the ICC has no jurisdiction over Israel and will be home free, unlike Palestine that is bound by the ICC and will be held accountable for any crimes committed.
Warrants will be issued and any one can arrest those criminal...

And that is where you fall down as the warrants for Israeli's can not be enforced, and any attempt to arrest them would cause an international diplomatic incident. The best that could be achieved would be very expensive private summonses for the parties to be brought before a court to answer the private summons. This was tried in the UK and the Palestinian family that brought the case ended up in debt and are still paying for their folly. The Israeli was allowed to leave the UK as planned and the police stated they were not a private force in the pay of individuals.
 
Interesting scenario.

Although Zionist Israel (and the USA for that matter) aren't signatories to the Rome Statutes, individuals can be investigated and prosecuted if they comitted crimes in the territory of a signatory to the Rome Statutes; within the jurisdiction of the ICC. So Palestinians can bring cases against IDF thugs, rapists and murderers and if found guilty, those criminals will be unable to travel to any of the 123 signatory countries without risking immediate arrest and imprisonment.

However, this also means that Zionist Israel cannot bring any charges against those Palestinians who committed any criminal acts within Zionist Israeli territory, as it is outside the jurisdiction of the ICC, not being a signatory. For the Zionists to do this it would require a Security Council resolution, with a good chance that either they won't get the necessary 9 votes or Russia, and/or China would veto (just to piss off the US).

WRONG The ICC has no jurisdiction to even issue arrest warrants for any Israeli. But Israel can bring charges against Palestine by proxy and have them arrested on war crimes. The other way is for Israel to issue warrants in the Isreali courts which have jurisdiction over palestine.
The other downside of course is that any investigation will uncover Palestinian war crimes which the ICC is duty bound to convict to the full, so leaving Palestine with a major headache as every member state of the UN will then be empowered to arrest and deliver the named war criminals. As two ISLAMONAZI leaders found to their dismay this means they are prisoners in their own country, and the UN will impose sanctions against them until they are given up into their custody. As always the Palestinians have opened a can of worms that they do not know what to do with, and now the reality is kicking in they are looking at ways to blame Israel for their own stupidity.
