The land law alone is an Apartheid law, within Israel. The citizenship law is another. Both separate the rights of Jews from the rights of non-Jews.

The law related to the JNF-KKL, is a protection for those that made an investment; and is control by laws of the Knesset (Parliamentary Law) which is a sectarian body; hardly apartheid in configuration. There are a number of countries in the world that have laws governing state property and protected lands.

The Nationality Laws, which control the granting of citizenship (residence, naturalization, descent and marriage) and, the Right of Return for Jewish diaspora, are similarly bound by the Basic Law and the will of the Knesset.

Neither of these sets of laws have any racial dominance motives since they are race, ethnic background, color, or nationality immaterial. One protects the contributors to the JFN-KKL and one is typical of any number of countries that have citizenship laws enacted by a Parliamentary system.

Just because the Arab-Palestinian cannot somehow twist these laws in their favor, doesn't make them "apartheid" in nature.

Minorities in G and WB suffer. Christians forced out or to convert. Muslims that convert to christianity are killed.
We have seen minorities from Iran to Egypt raped, brutalized, sold, killed. Pogroms, land theft, extortion, torture and other abuses have gone on throughout history in the region.
Jews and Israel are not the reason for apartheid. Israel gives arab more rights and freedoms that arab elsewhere. They vote, their serve in government, they are part of higher learning, science, medicine, law, technology as well as social and security services. 80% of arab in Israel would not want to be anything except Israelis.

There are no laws in Israel that lend advantage or penalize the difference between a Caucasian Jew and a Black Jew. If there were, then that would be the defining characteristic that could lead to "apartheid." But, in fact, I find no distinction between the laws in Israel that distinguish the difference between races.

The laws that pertain the Jewish are the same for each race --- Black or Caucasian. The laws that pertain to non-Jews are the same, Black or Caucasian. The "Apartheid Laws" are in place to prevent the discrimination against "a racial group or groups from participation" in otherwise lawful activities enjoyed by all citizens. (Non-Jew is not a race.)

The proper quote from the Article I of the CERD is: "the term "racial discrimination" shall mean any distinction, exclusion, restriction or preference based on race, colour, descent, or national or ethnic origin." There is no "racial discrimination" on the basis of "national or ethnic origin."

The "recognition" ---- "given to the historical connexion of the Jewish people with Palestine and to the grounds for reconstituting their national home in that country" --- was under the authority of the Principle Allied Powers during the San Remo Conference.

The two things have virtually little in common.
  • One is about "discrimination" and "apartheid."
  • The other is about recognition of "historic connection."

If you are referring to KEREN KAYEMET LE-ISRAEL LAW, when you refer to KKL, this is not as you've described because it incorporates the Land (Acquisition for Public Purposes) Ordinance (1943), a law enacted by the British under the Mandate. The KKL states (inter alia):
"Section 6: For the purposes of section 22 of the Land (Acquisition for Public Purposes) Ordinance, 1943(2), the new company shall have the same status as a local authority."
This entitles any Jewish company wanting to set up in Israel to "acquire" Israeli Arab owned land on which to build it's factory, offices, etc. This law has been abused to systematically steal land in Israel, still owned by Arabs. The law, regardles of original intent, which is a matter for interpretation anyway, has benn utilised in a way that is demonstrably discriminatory against Isreali Arabs, and so falls within the definition of the crime of Apartheid.

I'll return to the Nationality laws later.
