Is your phone safe from spyware?

Just saw this on the news. For $25 a month I can put spyware on your phone and when you text it will let me know you are texting and give me a copy of it and phone calls, your location, copies of any phonos or videos you take. But the saving grace is that it must be physically put on the phone. Some sites are being disguised to get cellphone owners to download the bug, some only require you to take a picture of a usb code. Makes one wonder when the hackers will acquire the capability to do it without physically loading it.
