Jillian keeps claiming that the Supreme Court was wrong for authorizing Military tribunals for the Gitmo detainees, INCLUDING KSM and the others recently granted a trial in Federal Court by THIS administration.

She and those that support the trials ignore the fact that KSM was already tried in a Military Tribunal and PLEAD GUILTY. And that Obama stopped the Court.

She and others have stated these men could not get a fair trial anywhere but in a civilian court, which says they disagree with the Supreme Court. She and the others have stated that KSM was never brought to trial, totally ignoring the fact he WAS tried and he pleaded GUILTY.

She and the others insist that the left made no effort to stop the military tribunals ever since the Bush administration announced they would be held.

So is the Supreme Court guilty of a perversion of Justice?

And if so then WHY is Obama and Holder going to allow some of the Gitmo people BE tried by Military Tribunal?

And how does one try a man in Federal Court if he was never given Miranda rights, never given access to lawyers for most of his incarceration, held by the military for years? Those all VIOLATE the rights of people that CAN be tried in Federal Court. The interrogations of these prisoners violate the rights of anyone that is brought before the Court in a Federal Court. How does the Government sweep these violations under the rug?

So shall I assume you think the right to an abortion is wrong too? After all that decision was 5 to 4 as I recall. Or is it just the decisions you do not like that are wrong? Partisan hack applies so well to you.

By the way Jillian, you do realize that your buddy Obama is going to let Holder have some of the terrorists actually tried by military Tribunals right?

Gee, I hate to burst your bubble, I really do. But the Dred Scott decision was overturned by the 14th Amendment. Nowadays , If an individual is within the federal court jurisdiction then he has the right to access the court.

He also confessed to murdering President Carter and to blowing up the Panama Canal. Guys say funny things when their nuts are being squeezed.

Provide evidence he said either of those things. And once again DUMB ASS, they are NOT in the federal COURT SYSTEM UNTIL OBAMA ALLOWS THEM TO BE MOVED THERE. The Supreme COURT ruled that Military Tribunals are legal and proper for the detainees at Gitmo and anyone else we capture in a similar manner OUTSIDE the United States.

Holder made a claim that Bush never tried them when in fact he did as soon as the Supreme Court cleared all the bogus challenges made on Military tribunals.

Having taken responsibility for the whole ball of wax along with everything else that he could imagine, he was the entire show. No other terrorists needed.

NONE of the Gitmo detainees where captured in side the US. they were all captured in foreign Countries. And until they are moved to New York KSM and his buddies will never have been in the US or under its Courts Jurisdiction.

They were brought into Guantanamo which is US soil. Those folks are Human Beings , they deserve the right not to be deprived of life or liberty without due process of law.

WRONG, they are not civilian criminals. They rate no time in a civilian court at all. They are illegal armed combatants. Gitmo is not US soil, it is Cuban soil.
 
I think the Obamites are making a huge misake. Voters will punish the D's come next Nov.

As for the SCOTUS, they have ruled that Military tribunals are legal. AG Eric Holder is a foolish, petty man who is more interested making political points with far leftist loons, than in punishing KSM and his ilk.

The USA does not own the land at Guantanamo Bay, but they do have the rights to do with the land what they want and pretty much have complete control of it at the moment. "The United States controls the land on both sides of the southern part of Guantánamo Bay (Bahía de Guantánamo in Spanish) under a lease set up in the wake of the 1898
Spanish-American War. So Guantanamo has the same legal status as an embassy.


On January 31, 2005, Washington federal judge Joyce Hens Green ruled that the Combatant Status Review Tribunals (CSRT) held to confirm the status of the prisoners in Guantánamo as "enemy combatants" were "unconstitutional", and that they were entitled to the rights granted by the Constitution of the United States of America. The Combatant Status Reviews were completed in March 2005. Thirty-eight of the detainees were found not to be combatants. On March 29, 2005, the dossier of Murat Kurnaz was accidentally declassified. Kurnaz was one of the 500-plus detainees the reviews had determined was an "enemy combatant". Critics found that his dossier contained over a hundred pages of reports of investigations which had found no ties to terrorists or terrorism whatsoever. It contained one memo that said Kurnaz had a tie to a suicide bomber. Judge Green said this memo "fails to provide significant details to support its conclusory allegations, does not reveal the sources for its information and is contradicted by other evidence in the record."

PR is special jurisdiction, different than the states

and btw....in 2006 obama was all for military tribunals.....obama doesn't know how to lead or make a decision it seems
 
The GITMO prisoners are a moral problem our children will judge us on as we judge our forefathers for the Japanese Internments and the Nuremberg trials. Let's hope we do the right thing.
