BS, buddy. If the government is seeking to award the contract, it can require the company to use only unions, or make its employees were green caps, or throw out aribtration for certain allegations. But that is not what is going on with this amendment to the legislation. The victim of the rape had and still has legal recourse against the actual criminals who were the rapists. Her complaint against the company, nor the amendment, had anything to do with them shielding rapists from any legal action by the victim against her assailants. Apparently the victim of the rape wants more than than to take legal action against them. She wants deeper pockets; she wants to sue the company for negligence, but she has agreed, a priori, to confine her legal recourse to arbitration, and the contract between her and the company still stands, as it was written.

The government may disallow arbitration in future contracts (because of this one criminal action) but it will result in higher costs all around to the governemt, just as any mandate adds to the cost of doing business, and limits bidders into the bidding process. In other words, the governemnt may only impose restrictions to contracts that both parties agree to at it's inception, and private bidders may simply pass on bidding on those contracts.

As I understand it there was no other American company which could perform this contract, and I'm not sure that there were any foreign companies who could have done it as capably.

The Republicans' top man on the Senate Judiaciary Committee lost a fight with Minnesota Democrat/Comedian Al Franken Tuesday when Franken pushed through an amendment to withold defense contracts from companies that restrict employees from taking a variety of workplace complaints to court.

The amendment passed over Sessions' objections with all Democrats and 10 Republicans supporting the measure.
