In 1790 the INA that was passed stated only free whites were allowed to naturalize to US Citizenship, not that citizenship was restricted to whites as there was already free blacks that were citizens of the individual state in which they lived, there was state citizenship and National Citizenship. The 14th had no bearing on others becoming US Citizens, since the 14th is merely declaratory of existing law. From the WKA case
