If you fast forward the legal concepts of 1864 to modern times Booth might have evaded execution. As a mater of fact if the political climate was right, Booth might have been able to plead insanity just like John Hinckley and democrats would have snickered.
 
How could he have beaten the charge? They executed people who were part of the plot, why not the actual shooter? I don't think your reasoning makes much sense.

Lee's surrender did end the war. There is no legal concept in the world that would have justified Booth's atrocity.

Hard to say where to draw the line between assassin and soldier. The uniform is not enough. If you are sleeping in a military camp and the enemy raids your camp and you jump out of bed and shoot an enemy soldier, are you an assassin just because you don't have a uniform on? THINK

Easy to say that is one of the worst fallacy examples of a derivative analogy we have seen ever on the board. He was hiding in a barn hoping not to die at the hands of the soldiers. He was not a soldier.
