I guess the defense will argue that the boy was only mostly dead.

So this story starts like so many others. Border Patrolman Swartz was driving along the border with Mexico near Nogalas. Ok so far. Then someone throws some rocks across the border fence. Ok. Yawn. Unless they have a catapult there is no way they can get a rock across the fence large enough to do any real harm. Oh they might ding the SUV or put a chip in the glass. But no big deal so far. Call the office and have them notify the cops on the other side of the border.

Not what Swartz does however. He stops the SUV and pulls his pistol as he approaches the fence and starts shooting. Wait. What?

You read that right. Border Patrolman Swartz shoots at a sixteen year old boy in Mexico for throwing rocks.

The boy Elena Gonzales falls to the ground right away. This isn't enough for Swartz who empties his magazine at the boy. Then Swarz reloads and fires a second magazine of ammunition at the boy. Ten rounds strike him while he is laying motionless on the ground.

Swartz is standing trial for this crime. His defense is objecting to a video recreation that shows ten bullets strike the boy as he lays prone already struck by at least one bullet. An unreasonable response to begin with taken to the ludicrous extreme.
