Hypo - you're blinded as a result of medical malpractice...

    Say you need eye surgery and you hire the best eye surgeon you can find

    Say you make $250,000 a year in your job.

    Say that eye surgeon messes up and a result of his negligence, you lose your sight for life and are now permanently blind. You lose your job as a result.

    $500,000 is enough compensation, right?

    Probably it is. It will certainly cover rehab. Sight is not priceless. To some a nail that was ten years growing is as priceless. Non compensatory damages in Ca is capped at $250,000. Unless an attorney can find punitive damages that is it.

    You go to the gas station hoping to afford gas enough to get home. Some guy looking for a thrill deliberately shoots you and you survive but blind. You get zip. Nothing. Making a plea for sympathy the perp gget six months for aggravated battery.

    If that 500k for pain and suffering? Or medical bills/lost wages? Or both?

    Say you are a housewife and have never worked and a doctor kills you with his negligence.
    And the state this happened in has a 250K limit on non econmic damages in medical malpractice cases.
    The family gets 250K BY LAW. ONLY.
    If a tractor trailer hits her car and the truck driver was at fault this would be a 2 million dollar case as tractor trailers carry that much insurance.
    Now what other profession is exempt from their negligence? And since doctors are dealing with life in their profession they SHOULD BE THE LAST to get any exemptions from liability.
    We need tort reform but not limiting a doctor's negligence.
    All that does is take rights away from victims. And in the states where they have had massive changes favoring doctors and limiting their liability there have been little to no decreases in their medical liability insurance.

    But it's better than zero, which is what hospitals pay when they have sovereign immunity.

    No, that is what freedom and liberty is all about.
    You fuck up and maim someone and your insurance refuses to compensate your victim of your negligence what do you expect? A thank you and tea party?
    As hard as folks try to paint everything as liberal versus conservative square pegs do not fit in round holes.
