CDZ How would YOU deal with this Business Situation?....

You promote someone against their will. What are they going to do, quit because they got promoted? Pretty sure that won't fly when they go to try to collect unemployment.

Not possible under the existing CBA. We would file a grievance immediately, and we would win it, even if it had to go to Step 3 (Union President & Company VP) or 4 (Arbitration). The Company really cannot use that level of bad press at this point in time.

I dare say "Union files complaint because employer promotes a worker" will create far more bad press for the union than the company.

How about this one..... "Union files new charges against (Company Name) over improper treatment of employee"

Considering that the Company has been villified (mostly rightly) over the past four years for everything from cutting 25% of their non-union workforce, failing to pay us properly, being fined tenst of millions of dollars for numeruos violations and announced a 36% rate increase over last year's winter rates.... the public has no sympathy for this Company at all right now.
 
If this was not a union, the Senior Tech job would be paying exactly what it should be paying, $100,000. At that salary, plus bonuses, the qualified individuals would be interested in taking the job. Get rid of the unions. Unions are a detriment to better businesses rather than incentives for good workers.

If this work wasn't Unionized, it would be done by personnel in another state where this company does business by people making about 80% of what the Tech makes, nevermind the higher Senior Tech pay. That was, in fact, the Company's plan prior to this department Unionizing in 2009.

I am wondering if these employees actually deserve the lower rate of pay. Listen to their what they say. They will take their inflated pay and take the less stress and not strive for doing their best at a job. They get paid extra for doing their best instead just that being part of the job. They don't deserve that inflated rate because their best is not what they are giving on a daily basis. The company would do better by moving the company out of state.

There is no change in the rate of pay unless they accept the promotion. That raise is not sufficient to make any of us take on the new role and stresses.

We get paid to do a job. We do not get paid to go above or beyond that role. In fact as the Steward I've had to remind several of the younger members of the department of that recently.

The company would love to move the work. Thankfully the Union and the Attorney General of the state won't allow that.
