Homeowner arrested for "illegal photography" of a cop who barged into his own house

So the solution is more video, not less? I suppose it's possible, cost and technology wise.

In Arkansas if you as a LEO fire your weapon or taze someone without having your personal video devices turned on, you can be fired. and in fact we just had an LEO fired for that not too long ago.

Cop Fired After Firing Taser at 10-Year-Old Girl Who Refused to Shower - Crimesider - CBS News

Officer Dustin Bradshaw was not terminated for using the stun gun itself, but for failing to use the camera attached to it, according to officials.

He should be prosecuted for child abuse, and they are firing him because he did not use a camera? That they don't have a problem with the fact that he shot a 10 yo girl shows just how screwed up the department policy is.

Do some research, the child was out of control, had attacked her mother on other occasions, and the MOM asked the LEO to stun her.

The child was 10 years old. I do not care if the pope asked for her to be Tazed, it was wrong. There is no way you can convince me that an adult male needs to Taze a child just because she is a brat.

She wasn't just a brat, she was out of control. Attacking , biting, scratching, etc etc. The voltage was tuned out appropriately. Would you have preferred he man handled her to control her? I suspect not.

I will state this as clearly as I can.

There is no reason for an adult human male to need to use a Tazer on a 10 year old girl in order to control her, even if she does kick him in the nuts. If he is having so much trouble that he actually needs help backup is always available.

And I will say this as clearly as I can. Clawing and biting can lead to open wounds, open wounds potentially transmit diseases. no LEO should have to risk that. That is exactly why the tasers are adjustable.

I realize though that you will ALWAYS be against an LEO no matter the situation, so I will bow out of this conversation.

Tasers are weapons that are classified as less lethal. Would that same LEO be justified in pulling a firearm and shooting that girl? If not, he should not pull his Taser and use it, because he is risking killing her. This is not a matter of me bashing LEOs, it is a matter of common sense. Tasers should be used only when police are in immediate deadly danger and do not want to kill a suspect, they should never be used for anything less than that. They are not compliance tools, they are weapons.

One more response. You are wrong. I could produce video after video after video of LEO using tasers as COMPLIANCE tools, as they were designed, same as pepper spray or whatever.....

HOUSTON (CN) - A homeowner says he was arrested for "illegal photography" when a police sergeant followed him into his own home, and he objected and took the cop's photo with his cell phone. "We did not know what he was talking about, and I don't think he does either," the homeowner says in his federal complaint.
In his civil rights complaint, Francisco Olvera says Sealy Police Sgt. Justin Alderete's charge of "illegal photography" baffled him and several witnesses

Olvera says he was acquitted of all charges in a jury trial.
Olvera seeks punitive damages from Alderete, the City of Sealy, and Police Chief John Tollett for trespass, assault, false imprisonment and malicious prosecution.

Well, I hope the city is ready to fork over a nice big check to Olvera.

Thoughts USMB?

Another crazy cop incident. Sheesh

They are not weapons, but some states restrict ownership of them anyway. I fail to see the logic of your argument here, you being in the military especially. The Army has issued guidelines prohibiting using them on soldiers or civilians in training because of the risks involved, yet you see no problem with Tasing a child. Yet you went apeshit when I, among others, thought a 16 yo female could handle a solo sail around the world.

Cops can call for backup, they do not need to Tase a child.

Please tell me where I said that I personally saw noting wrong with tasering that kid. I in fact did NOT say that, what I did say was that what the LEO did was within police guidelines. Would I have tazed her? I'd like to say no, but on the other hand, I wasn't there.

I was with a state trooper once when a meth head just wouldn't respond to commands, he was backed into a closet and wouldn't come out. He kicked, he bit, he scratched, he spit, and he just wouldn't come out of that corner. Finally the Trooper had enough and tazed him. we pulled him out with minimal damage to him or us. Turns out he wasn't a meth head, he was just a 14 y/o kid who's parents had pretty much let him turn feral. The parents sued the Arkansas State Troopers. The case went nowhere.

There are ALWAYS two sides to EVERY story.....

and without even reading your post, I KNOW it will be child like.

I actually made zero claims about the LEO being right or wrong.

You know, the more I think about this, the angrier I get. How on EARTH do they think they are going to be able to justify a law making it illegal to photograph an on duty cop?

You all do understand the basis for a law such as this, right? Remember the Rodney King case? Or any of the dozens of other cases which involve videos taken by citizens of police kicking a suspect's head in or otherwise brutalizing the person(s) they were about to arrest.

Fast forward now to the conservative view of police work. It goes something like this: "If you run afoul of the law, you deserve everything you get and then some. Run from the cops, don't complain if you get the crap kicked out of you once they catch you. You shouldn't have run in the first place. Mouth off to a cop, you deserve everything you get. We are law abiding citizens. We do not tolerate people who aren't. And the LAST thing we are going to do is punish our own, brave officers who are out there, risking their lives every day to protect US, by having to deal with scum like YOU."

I think you get the picture.

If you buy into that view, then passing a law that prevents citizens from making videos of cops kicking the crap out of suspects, makes perfect sense.

"Invasion of privacy" my ASS. As is so often the case, there is a hidden agenda here. I have just set it forth.

Son of a BITCH!!!!

(George does not normally use foul language. When he does, it is an indication that he is REALLY upset. Even now, that vein on his forehead is standing out . . . )

Almost, almost agreed with you here and the you had to partisan hack on us. Cons are not for this type of bullshit law. As a conservative I can tell you that I want ALL police taped with video and audio AT ALL TIMES when on duty. Police abuse of power is a plague on our honest cops out there. It seems ConHog feels similar and he is hardly a lib. No need for partisan bickering when there are laws like this in place everyone should be fighting.

A Taser is not a weapon?! Everyone, including the company that makes them, calls them a weapon. Please explain to me how you can possibly define weapon in such a way as to exclude Tasers.

As for the story, it does not matter if there are 15,000 sides to this story, any policy that allows fully grown and trained men to Tase a 10 yer old girl rather than call for backup, or just leave her alone until she wears herself out, is wrong. I never questioned anyone's story, I challenged the policy that allows children to be tazed. You have repeatedly argued that I was wrong for about this, and now you are trying to claim that you have a problem with it.

That dog don't hunt.

What the hell is "illegal photography"? Was the cop afraid that the guy was stealing his soul if he was photographed?

Its easy, he was Amish?

I thought it was the Congoids who were afraid of cameras?

And yes QW, a taser is a weapon. I never said it wasn't. But it is a non lethal weapon, no different than other weapons that at LEO disposal. No agency limits their use to a life or death situation, and in fact if you take a federal law enforcement training course in Glynnco, GA they teach you to use the taser in just the way LEO do daily as a way to control suspects who don't wish to be controlled.
