So, If a person is killed or injured during the commission of a crime the previous still stands. I don't disagree with this.

So it all depends on how good (or bad) a shot the criminal is? Isn't threatening someone with deadly force during the commission of a crime good enough for you?
No...it depends on real action as opposed to intent. The job of a judge is not to simply smack his gavel and yell "order!" or hand down sentences as written in law. Judges are there to interpret law and take into consideration certain, if any mitigating factor's in a case. With mandatory sentencing this job has been stripped from a generally, very learned population (judges) and placed into the hands of prosecutors. A population whose sole purpose in life is their conviction rate. We have to start learning to THINK individually, case by case. Judges are placed there to do this. This is a good step.
