1. Those diagnosed as Mentally ill.

2. Those mentally ill enough they can't handle their own finances.

Republicans were outraged. President Obama, last December, signed an executive order while waiting for the legislation to come up for a vote. In front of a Republican cheering crowd, that order was repealed.

The reasoning was that just because you are mentally ill doesn't mean your gun rights should be taken away.

In Louisiana, one of the most notable cases using the amendment involves Glen Draughter, 20, of New Orleans, a felon convicted of simple burglary who was later caught riding in a car with a handgun in the backseat and an AK-47 with a 30-round clip in the trunk – a violation of state law. His lawyers brought the case to court, arguing that the new amendment gives him the same "fundamental right" to bear arms as anyone else, and his gun possession case should be dropped.

That is the whole point of the fifth amendment. A person can only be deprived of life, liberty, and property by due process of law.

A finding by a bureaucrat is not due process of law. That is why the National Security Letters the Patriot Act created were unconstitutional.

But, if they can't handle their own money they probably can't handle a firearm. No one has bitched about it at all.

So now Obama decides that it might be a good idea for the Social Security administration to follow the same procedure. If you have been determined mentally incompetent to handle your own finances, and that incompetency is due to a "mental deficiency", then you probably shouldn't have a firearm and your name should be reported to the NICS.

Hell, these are people with no military training. Hell, for the most part, no training whatsoever. SSI--haven't even worked enough to qualify for disability. These are people with no job, no ability to get a job, no high school diploma, nothing. But their names should not be reported while veterans are? Is this madness?

And the whole court argument, it is bullshit. First, it is kind of telling--you can take someone's money away from them without a judge, but their gun--oh hells no. I guess the government ain't afraid of your gun, it is the money they don't want you to have. But that is just it, not a single one of the people in question here, either those with a assigned payee at the VA or Social Security, have not been denied a day in court. They have every right to appeal, and upon notification of their assigned payee status the are both informed of their appeal rights and the VA notifies them that their names will be reported to the NICS. No problem.

Basically, it is kind of simple. If you have got enough sense to rub two pennies together you are OVERQUALIFIED to own a gun.

Perhaps you can help me here. Because I've never understood this attitude. When is it ever a good excuse, someone else is doing it wrong too, so I should be allowed to. This nonsense is heard all the time, and I don't understand it. Oh you can't ticket me for speeding, everyone else was too. You can't blame me for burning leaves in my yard, everyone else was too.

The wrong thing is the wrong thing, no matter who or how many do it. Depriving someone of their civil rights because they are a veteran is wrong too. Using the wrong thing as a foundation to deprive others is wrong.

National Security Letters are wrong. No matter who, nor how many times, it is still wrong. Civil Forfeitures are wrong. And depriving someone of their civil rights without a court is wrong. I will always argue against a wrong. I will always speak out against any wrong I see or learn about.

Oh these Republicans. So concerned about the rights of the mentally ill to own guns. They need to protect themselves from imaginary threats.

Like they are concerned about the health care of miners and the elderly.

Like they are concerned about newborns and mothers.

Like they are concerned about children.

Like they are concerned about veterans.

They are just a pool of concern. A cesspool.

Whenever you stop lying that will make it possible to discuss this or any other issue. Drop the propaganda for a change.

If the person is judged as insane by a court, based upon findings by a psychiatrist then they are, and should be restricted from guns. Depriving anyone of their rights can only be done by law. That is the whole point of the fifth amendment. A person can only be deprived of life, liberty, and property by due process of law.

A finding by a bureaucrat is not due process of law. That is why the National Security Letters the Patriot Act created were unconstitutional.

OMG, the same old lame argument. So, the VA determines someone is not competent to handle their own finances. And the VA makes this determination based on a "mental deficiency". The VA reports those individuals to the NICS. They have been doing it for decades. These are veterans. They have been trained in the use of firearms. But, if they can't handle their own money they probably can't handle a firearm. No one has bitched about it at all.

So now Obama decides that it might be a good idea for the Social Security administration to follow the same procedure. If you have been determined mentally incompetent to handle your own finances, and that incompetency is due to a "mental deficiency", then you probably shouldn't have a firearm and your name should be reported to the NICS.

Hell, these are people with no military training. Hell, for the most part, no training whatsoever. SSI--haven't even worked enough to qualify for disability. These are people with no job, no ability to get a job, no high school diploma, nothing. But their names should not be reported while veterans are? Is this madness?

And the whole court argument, it is bullshit. First, it is kind of telling--you can take someone's money away from them without a judge, but their gun--oh hells no. I guess the government ain't afraid of your gun, it is the money they don't want you to have. But that is just it, not a single one of the people in question here, either those with a assigned payee at the VA or Social Security, have not been denied a day in court. They have every right to appeal, and upon notification of their assigned payee status the are both informed of their appeal rights and the VA notifies them that their names will be reported to the NICS. No problem.

Basically, it is kind of simple. If you have got enough sense to rub two pennies together you are OVERQUALIFIED to own a gun.

Perhaps you can help me here. Because I've never understood this attitude. When is it ever a good excuse, someone else is doing it wrong too, so I should be allowed to. This nonsense is heard all the time, and I don't understand it. Oh you can't ticket me for speeding, everyone else was too. You can't blame me for burning leaves in my yard, everyone else was too.

The wrong thing is the wrong thing, no matter who or how many do it. Depriving someone of their civil rights because they are a veteran is wrong too. Using the wrong thing as a foundation to deprive others is wrong.

National Security Letters are wrong. No matter who, nor how many times, it is still wrong. Civil Forfeitures are wrong. And depriving someone of their civil rights without a court is wrong. I will always argue against a wrong. I will always speak out against any wrong I see or learn about.

I argued against these things under Bush. I argued against them when Obama was in Office, and I'll probably argue against them with whomever comes next.

Bullshit. You never argued for the Vets. Over twenty years, not a peep. And funny thing, those Vets still get denied the right to a firearm each and every day. Because it is THE LAW. But Social Security doesn't, why?

And the day in court argument is ignorant. If I get a speeding ticket and pay it off, I don't go to court. Does that mean I didn't get "due process"? No, I waived my right to a court appearance. These mentally ill people have done the same thing. They were denied the right to a firearm and they waived their right to a hearing. They can't come back now and cry "due process". In fact, at anytime, they can file for a hearing.

Wow you know what I thought and said two decades ago. Perhaps since you are all knowing you can help me. I had a pair of orange beach pants that I got in a care package from my folks in Saudi during Desert Shield. I lost them about twenty years ago. I always wondered what happened to them. Obviously I don't expect to recover them now, like I said I was just curious.

I got out of the Army about twenty years ago. I began arguing for and against a lot of things. One thing I have consistently argued for is civil rights.

Perhaps my side will get to define your side as the “crazies”, and by the very principles that you are demanding, we'll have the power to deny you your basic rights.
