Ex-Goldman Sachs Director Charged
03/01/11 -- The Securities and Exchange Commission is bringing charges against Rajat Gupta, a former director of Goldman Sachs(GS) and Procter & Gamble(PG) for allegedly providing inside information to Raj Rajaratnam, a hedge fund manager for Galleon Group.
Gupta gave Rajaratnam information about quarterly earnings at Goldman Sachs, Procter & Gamble and also informed him of the $5 billion investment Berkshire Hathaway(BRK.B) made in Goldman in September 2008, according to the charges. According to the SEC, Gupta allegedly tipped off Rajaratnam immediately after Goldman's board approved Berkshire's investment in Goldman Sachs. That same day, just minutes before the market close, Rajaratnam allegedly arranged for Galleon funds to purchase more than 175,000 Goldman shares. In addition, Gupta told Rajaratnam insider information concerning the second-quarter 2008 results, the SEC says.

"The insider trading by Rajaratnam and others generated more than $18 million in illicit profits and loss avoidance. Gupta at the time was a direct or indirect investor in at least some of these Galleon hedge funds," according to the press release issued by the SEC. Gary Naftalis, an attorney at Kramer Levin, is representing Gupta said that the SEC's allegations are baseless. "Mr. Gupta has done nothing wrong and is confident that these unfounded allegations will be rejected by any fair and impartial fact-finder. There is no allegation that Mr. Gupta traded in any of these securities or shared in any profits as part of any quid pro quo," said Naftalis in a statement. "In fact, Mr. Gupta had lost his entire $10 million investment in the GB Voyager Fund managed by Rajaratnam at the time of these events, negating any motive to deviate from a lifetime of honesty and integrity."

The SEC has charged Rajaratnam and others in a insider trading scheme. Several have pleaded guilty to the charges. Rajaratnam's trial in federal court is scheduled for March 8.

I wouldn't say ever so slightly, he is more left then Wilson and FDR put together. No other president in history has run so rough shod over his own people when it comes to legislation. 70% of Americans did not want the Socialist health law to be passed, but yet he still signed it into law. That's not slightly, that is full tilt.

A former Goldman Sachs board member who was found guilty of four criminal counts of insider trading has sentenced to two years in jail. Rajat Gupta, 63, had leaked boardroom secrets to Raj Rajaratnam, a former hedge fund manager now serving 11 years in prison. US District Court Judge Jed Rakoff also ordered Gupta to pay a $5m (£3m) fine. Gupta said he regretted the impact of the case on his family and friends.

Reading from a statement, he said: "The last 18 months have been the most challenging period of my life since I lost my parents as a teenager." He added: I've lost my reputation I built for a lifetime. The verdict was devastating." During the court case, which resulted in Gupta being found guilty in June, the jury heard secret recordings of conversations between him and Rajaratnam.

The trial focused on a phone call made to Rajaratnam on 23 September 2008, minutes after Gupta had listened to a private conference call discussing a $5bn (£3.2bn) investment in Goldman Sachs by Warren Buffett's company Berkshire Hathaway. The deal was due to be made public after stock markets closed that day.

According to phone records, Rajaratnam bought $40m in Goldman Sachs stock moments after the phone call, earning nearly $1m. Gupta, who was born in India and educated at Harvard, also served on the boards of Procter & Gamble, the Rockefeller Foundation and the Bill and Melinda Gates Foundation.

perhaps if goldman sax were actually one of the top five contributors that might be true...

but it's not... these are obama's top five contributors, each is in the 2 million dollar range.
