Experts: Legal challenges to Trump emergency declaration face uphill battle

It would be difficult to accept that the courts would support the kind of invasion going on at the border. Not impossible. Difficult.
 
Congress writes the laws; the Executive executes the laws; and, where there is a dispute as to what a law means; the Courts interpret the law. See Constitution.

In this case, Congress passed a law that gave the Executive vast authority to determine what was an emergency and what is a threat to national security, and the President has now used that authority.

In 2012, Obama declared the Mexican drug cartels a NATIONAL EMERGENCY and a THREAT to our National Security. No Socialist (i.e. Democrat) said a word.

Trump is building on that Obama Executive Order.

The Courts will interpret whether the President has overstepped his "vast authority". The only miscarriage of justice in the process establish in our constitution is that the Socialist (a/k/a Democrats) will find an Obama-Judge to rule in their favor to begin with. That is a certainty....because they will be "forum shopping" for judges, which is technically illegal, and an Obama Judge will ALWAYS rule in favor of the Socialists. Obama-Judges are purely political.

But the experts are right to assume that when the matter is considered on appeal by Honest Judges---the President will prevail. If the Socialists don't like it, they can seek to change the law passed by Congress which gave the Executive** that vast authority.

For those of you educated in rotting Northern cities run by Socialists and their Teachers Unions for 4 decades, the Executive Branch is run by the President, currently one Don Trump.

Elections have consequences.

If I were a judge I would refuse to even take the matter up. I was alarmed when the notion of a national emergency first came up regarding the wall. Then looking at the law itself it provides congress a means of terminating the emergency by resolution. Thus with a check-and-balance in place I don't see the need of the court to get in on the act.

Now if I were a congressman I would likely vote to rescind the national emergency because this one has character of a president overstepping congress.

Since congress has already acknowledged its a national emergency by funding the border wall, the Dem's goose is cooked. Plus the Dem's previous statements on building the wall and previous congressional votes to fund the wall. Dumb ass Dem's will be laughed out of court. :21:
 
If you look at the list of national emergencies declared by all the Presidents since that law was enacted, you will see that it has been used for sanctions and financial restrictions against countries behaving badly. They are still in effect, which means they are approved by Congress every year.
Get that? APPROVED BY CONGRESS.
Was the funding of the Wall approved by Congress? Big fat NO.

What Trump is doing is NOT business as usual, folks.
