Ex-RCMP officer who investigated pension-fund scandal sues government over discharge from the force

More than ten years ago, a pension-fund scandal rocked the RCMP, prompting high-level resignations and an overhaul of the police force’s governance. Now a central figure in the scandal’s investigation is suing the government, alleging he suffered mental illness due to his treatment by senior officers and claiming he was pressured into signing a medical discharge.

Mike Frizzell, who was an RCMP staff sergeant assisting with the pension investigation in 2005, filed the statement of claim in Ontario Superior Court on Aug. 21. It seeks $2.8 million in damages.

The lawsuit outlines how Frizzell spent seven years on medical leave in the RCMP before signing a discharge in the summer of 2015. Frizzell, who joined the force in 1990, now works as a manager for an Ottawa-based firm that sells heavy drilling equipment.

The RCMP was besieged in the mid-2000s by revelations its pension funds were being misappropriated, with millions of dollars being spent on non-pension items. The story escalated when it was alleged Frizzell’s superiors had ordered him to cease his investigation into the matter.

In 2007, then-deputy RCMP commissioner Barbara George was brought before a parliamentary committee to explain her actions in regard to Frizzell. The committee concluded her testimony was dishonest, and the House of Commons later voted to censure her, an unprecedented rebuke of a senior RCMP officer. (George retired from the RCMP in 2008, but has long said the committee treated her unfairly, and some Liberal MPs have since said they regret how the vote took place.)

In his lawsuit, Frizzell says the written order he received in 2005 to stop his investigation came at the same time rumours were circulating that he was suffering from mental illness. The lawsuit alleges these two things “had the effect of creating the impression that Frizzell had been insubordinate and/or that he had been removed from the investigation because of his mental health.”

The RCMP did not respond to a request for comment on the lawsuit, and no statement of defence has yet been filed. None of the allegations have been proven in court.
