SOUTH HAVEN, MI David Johnsons attorney argued Wednesday that intervening issues, not just the actions of his client, played a role in the crash last month that killed a Bangor woman and two toddlers.
Among the issues, Darrell Fahey said, were toxicology tests that showed that Brittney King, the other driver involved in the fatal crash, had high levels of heroin and a narcotic pain reliever in her system at the time.
And Fahey pointed to testimony from a Michigan State Police crash reconstructionist who said he believed that Cassadi Berryhill, 4, and Kandice Berryhill, 2, who were both passengers in Kings vehicle, would have survived the crash had they been in proper child-restraint seats.
