Did New York State Just Accidentally Outlaw ALL Firearms?

You fucking idiots. That law simply says if you own a gun, now or before the date of the bill, that you must register it. Thats all. It says it is illegal to own an unregistered gun, not to own a gun.
ONLY for those who legally own a firearm prior to the law. Otherwise, one cannot own a firearm in NY.

- Further restrict assault weapons to define them by a single feature, such as a pistol grip. Current law requires two features.

- Make the unsafe storage of assault weapons a misdemeanor.

- Mandate a police registry of assault weapons.

- Establish a state registry for all private sales, with a background check done through a licensed dealer for a fee, excluding sales to immediate relatives.

- Require a therapist who believes a mental health patient made a credible threat to use a gun illegally to report the threat to a mental health director who would then have to report serious threats to the state Department of Criminal Justice Services. A patient's gun could be confiscated.

- Ban the Internet sale of assault weapons.

- Require stores that sell ammunition to register with the state, run background checks on buyers of bullets and keep an electronic database of bullet sales.

- Restrict ammunition magazines to seven bullets, from the current national standard of 10. Current owners of higher-capacity magazines would have a year to sell them out of state. Someone caught with eight or more bullets in a magazine could face a misdemeanor charge.

- Require that stolen guns be reported within 24 hours. Otherwise, the owner would face a possible misdemeanor.

- Increase sentences for gun crimes including for taking a gun on school property.

- Increase penalties for shooting first responders, called the "Webster provision." Two firefighters were killed when shot by a person who set a fire in the western New York town of Webster last month. The crime would be punishable by life in prison without parole.

- Limit the state records law to protect handgun owners from being identified publicly. The provision would allow a handgun permit holder a means to maintain privacy under the Freedom of Information law.


- Require pistol permit holders or those who will be registered as owners of assault rifles to be recertified at least every five years to make sure they are still legally able to own the guns.

This thread is chock full of folks that have not read the details of the law.
There is no hidden agenda in the law and nowhere does it say you cant own a gun.

I believe it was a bit overkill.....but that is Cuomo's style.....but the law does not take anyones right away to own a gun.....but ti DOES infreinge on Doctor (shrink) / p[atient confidentiality...which in this case is probably a good thing.

I do feel Cuomo may have compromised his chances for a presidential bid with that speech of his.....almost reminded me of Dean and his "Yee Haaa" speech.

Too bad. He may have been my choice for the 2016 election. I like the guy. He gets shit done.....the right way. May not agree with many of his initiatives.....but at least he doesnt ram shit down my throat and feed me bs about "the voters made it clear what they want."

Under current New York law, background checks on purchasers are
required for all purchases of guns from gun dealers and at gun shows,
however, individuals that purchase guns through private sellers are not
required to undergo background checks. This bill requires background

Did the New York state legislature just accidentally make it a crime to merely OWN a firearm?

See page 22 of the posted bill, s2230:

§ 41-a. The penal law is amended by adding a new section 265.01-b to 5 read as follows:
6 § 265.01-b Criminal possession of a firearm.
7 A person is guilty of criminal possession of a firearm when he or she:
8 (1) possesses any firearm or; (2) lawfully possesses a firearm prior to
9 the effective date of the chapter of the laws of two thousand thirteen
10 which added this section subject to the registration requirements of
11 subdivision sixteen-a of section 400.00 of this chapter and knowingly
12 fails to register such firearm pursuant to such subdivision.
13 Criminal possession of a firearm is a class E felony.

The way I read it, you are in criminal possession of a firearm if you possess a firearm and have not registered it. If you have not registered it, that is a Class E felony.
