And he is wrong. We still have the appeals Court and then the Supreme Court. It aint over till 9 Justices in black say it is.

I suggest you read the tax laws. Obama and Company are claiming it will be a tax not a fine if one refuses to purchase health insurance. That alone is unconstitutional, you see "taxes" have to be applied EQUALLY across the entire Country. Tax brackets are legal because within each bracket everyone is taxed the same way. Claiming a fine is a tax just won't work, as then the tax brackets treat people within said bracket differently.

Further as far as I know there is no legal cross State medical coverage. Every State has its own laws and every medical insurer must recreate their business WITHIN each States borders and can not use groups from out of State to effect premiums or rules within each state.

Thus no Interstate Commerce, which is what this Judge claimed allowed the Fed to create the system.

That was only after the argument that they could do so under the Commerce Clause was shot down.

Actually it is a judges job to interpret laws and hence the constitution. thats why we have courts. They are the branch of government charged with interpretation of US laws. The executive branch must enforce laws and the legislative branch must create or repeal laws. (now obviously there are checks and balances, but this is the function of government in its simplest form)

it says those words nowhere. but it also doesn't permit them from regulating or imposing any laws that regulate it either. the constitution is a broad piece of legislation overall. it only outlines certain specific rights and privileges. (ie free speech, freedom of religion etc). to counter your argument on that premise, it states nowhere in the right to an abortion either, but justices have interpreted the right to privacy to include that.

hence why judges exist. you can call him corrupt, but he is charged with the interpretation of the laws in existence. and based on his legal opinion and interpretation of the law, he ruled accordingly. now you can disagree with his decision, but his word is final in that courtroom.

Comparing an EARNED retirement package for services rendered over 20 years or less if medically retired to a poor private citizen that is not working and living off the Government tit is hilarious.
