I suggest you read the tax laws. Obama and Company are claiming it will be a tax not a fine if one refuses to purchase health insurance. That alone is unconstitutional, you see "taxes" have to be applied EQUALLY across the entire Country. Tax brackets are legal because within each bracket everyone is taxed the same way. Claiming a fine is a tax just won't work, as then the tax brackets treat people within said bracket differently.

there a slight hole in your argument here that taxes are applied "equally". as they are not applied equally. everyone has different tax status. if we simply had a flat tax rate then, taxes could seem to be applied equally. as it stands the tax code is so large, most of the general public doesnt understand it. now there are tax brackets, but they differ depending on if you are single, married, have children, own a home, own a business, have investment income etc etc. some people get affected by the AMT, some dont. so simply saying taxes get applied equally simply isnt true. if you fail to pay your taxes on time you can be fined. if you misrepresent your taxes, you can also be fined. whether it is called a fine or a tax, it is currently the law (although the enforcement of the law will not take affect for several years)


odds are that this law will be upheld. the government can mandate taxes, and this will most likely be one of the arguments for mandating health care.
