If the measure should pass, New Haven will join Chicago and several towns in Maryland which allow foreign nationals to vote in municipal elections.

If the voters of a given jurisdiction want to allow non-citizens to vote in local elections, what grounds do you have to be critical?

There's no such thing as "being here illegally". An "illegal alien" is simply someone who committed the misdemeanor of failing to stop at the border for inspection before entry. They may be deported, of course, to their home country, but they aren't breaking the law simply by "being here" - they broke it only at the point of entry. And furthermore - states and local governments are allowed to determine the qualifications of their voters, so long as they include all citizens over 18 who have not committed felonies, they are free to include or exclude anyone who does not fall into that group. If a state or locality wanted to allow anyone 12 years old and up to vote - they could. If they want to allow felons to vote - they can. And if they want to allow non-citizens to vote, they may also do that.

They might allow whomever they please to vote in their local elections. They cannot dictate who can vote in State or Federal elections.

A. Depends on the state's own laws. A state may allow local jurisdictions to determine voter qualifications (so long as Constitutional).
B. There's no such thing as a Federal election. All elections in this nation are conducted by the states or lower level jurisdictions.

Yes they did. Illegal entry is a criminal misdemeanor.

Wrong. Its not a crime to reside in the U.S. without documentation, its only a crime to ENTER the U.S. without stopping for inspection. In fact, the statute of limitations attaches, so that if someone enters without inspection, and resides for 5 or more years - the government can only deport them, they can't even charge them with a crime, as the statute of limitations is 5 years for illegal entry and the act of residing isn't itself a crime.

That's the law. You may not like it - but that's what it is.

I add one caveat - that illegally entering again after previously being deported is a felony.


But point is there is no such thing as "residing illegally" - at least not federally. You can only ENTER illegally. As a non-citizen without permission to stay here, of course, we can send you home whenever we like (deport) - but the only crime committed was at entry - and that's just a misdemeanor.
