The fundamental difference today between liberals and conservatives, and dare I say old time conservatives...the few that exist, is the idea that 'the market' is king.

Are we now to be salary or interest slaves to the invisible hand of the market? Can prosperity only come from the market? When did the market become god?

I am NOT saying I am anti market, but I am saying the market is a man made beast that must always be tamed.

..non-smoking workers and patrons have other options, why not???

case in point: why not allow drugs and porno to be sold within two feet of grade schools? surely we want to be able to allow the future to be free of regulation and constraints.

I responded to your statement that my argument supposedly lacks perspective because you say "business owners to not operate in a vacuum" and YOU brought up the market place as if the market could not bear it?

The with VAl's argument is IT lacks perspective. It is based on teh assumptions that a "business owner' lives and operates in a vacuum and that somehow tehy market place with dictate and that is a good thing.

Well, an owner might have a superior restaurant and be a big dick. He might want to subject people to all sorts of things.

Look at smoking....where people know smoking leads to disease and illness, yet they are self destructive.

I do not propose the govrenment protecting everyone from stupidity and human nature...but it does have a role in regulating what others can get us to do in order that they make a buck.

Every state and city has laws against littering...including cigarette butts. Better to enforce the laws on the books than kowtow to a bunch of nazi Progressives.

Those laws have been around for decades but did smokers ever learn to obey them? All the more reason to have a no tolerance policy towards the smokers.
If anyone is a Nazi, its a pig headed smoker who wants to push her drug on everyone around her.

You still have a problem understanding free will and choice. People can choose to walk into or not walk into a restaurant.

Glad to see you support making it illegal to smoke outside or in any building where the the air can get outside.
