Are you sure about that? I ask because there are some crimes where it's possible for the victim to drop charges.

I am sure of what I said, yes.

It is always possible for an alleged victim to ask the police or prosecutor to drop the charges. That does NOT always mean that the police can do so or that the prosecutor will.

For example (I leave California out of this discussion, for now, since I am not admitted in California), here in NY if a spouse calls the cops and alleges physical abuse by her spouse, the police MUST make the arrest. Discretion was curtailed to avoid the situations that sometimes arose where a cop would use discretion, not make an arrest and then the husband (usually the husband) would end up again assaulting or even killing his wife.

Furthermore, it is black letter law in NY that a prosecutor makes the call on whether to bring charges, if so which charges and the decision of how or whether to proceed on such charge(s). It is NOT at all uncommon for a wife or girlfriend to cry to the prosecutor that she wants the charges dismissed (often for economic reason). They cry and say, "but he'll never do it again!" Yet that crying request often leads to a refusal to do so by the prosecutor.

I remember telling a couple of allegedly abused wives in sum and substance that "you say he will never do it again and you say that because he just promised it to you; but that's probably what he said the prior five times he assualted you and you dropped the charges. Sorry. Not this time."

Again, the call is NOT the victim's to make. When a guy violates the law (such as by assaulting his spouse) the victim is a WITNESS, but it is the PEOPLE who bring the criminal action. It is OUR laws that have been (allegedly) transgressed.

Now, having said all of that, let's get real. If a victim-witness is going to be deliberately uncooperative, the prospects for successfully prosecuting the charges diminish a LOT.

One more thing: The scumbag Polanski is already convicted. The victim thus has NO valid say in whether or not he now gets his agreed-upon sentence. The scumbag SHOULD get sentenced as agreed (to whatever sentence within that range strikes the judge as being fair and reasonable). PLUS, since the fucking skell fled, he should ALSO now get prosecuted for the California equivalent of Bail Jumping.
