Cali Supreme Court upholds Prop 8

I told everyone the chance the court would turn it down was very small. Thankfully this Court realized its Constitutional Limits and refused to go beyond them.
 
"People have a right through the ballot box to change the constitution" is what I hear the opion says.

Hmmmm, I guess the arguments around whether the ballot initiative amended the constitution or revised it will be carried further if possible. Otherwise gay marriage proponents are going to have to play the ballot initiative game until they win...then the opponents of that can play the ballot intitiative game until they win...then...

I always thought amendments came through the process of a constitutional convention---that is until I moved out here to the liberal :lol: west coast.

NONE of the US Constitutions amendments came because of a Constitutional Convention. In fact that is a down right BAD idea, as such a convention could change the entire Constitution rather then amend it.

We obviously look at it differently. Since marriage is a right (as ruled by SCOTUS) then denying any two people of consenting age that right is not something that can or should be voted upon.

Not according to your liberal buddies. They all agree that THEY can limit that supposed right anytime they want if it OFFENDS them, like Incestuous Relationships.

i agree.....even though i dont see why if the state gives them the same marriage rights as everyone else,they wont give them the dam paper.....marriage is a religious thing mostly anyway.....
 
I feel bad for anyone who thinks that marriage is a positive thing. Do you really want to ask the government for permission to live with someone you love? That's all a marriage license is... and we pay for the privilege.

Yes, I understand that we get tax breaks for it, but I really think that government should get out of the business of marriage.

So, until the law respects the gay marriages performed by churches that want to do them, it is not equality, it is control of religious belief.

Actually, it's even worse than that.

The "contract" crated by the state marriage license is in fact what would otherwise be an illegal adhesion contract made legal.

Think about it....The "contract" is totally open-ended....There are no predetermined terms and conditions for fulfillment or default....Only one party -the state- can declare the "contract" null and void.

In any other context out in the real world, there isn't a judge or jury that wouldn't declare that "contract" null and void ab initio.

But the plaintiff didn't question the validity of the statutory nexus in the marriage, just whether it could be denied on the basis of ethnicity.
