Bush Commutes Libby's Sentence

When I consider that Sandy Berger was fined US$50,000, received 2 years probation and 100 hours of community service for actually violating the US Codes regarding classified material (a substantive crime); I find that Libby's sentence was excessive considering his convictions were only process crimes.

I think the US$250,000 fine and probation is appropriate. Regardless of how Libby's appeal of his convictions turns out, I hope this is the last action GWB takes WRT Libby's case.

Presidential candidate and New York Sen. Hillary Clinton described actions that led to Libby's conviction as part of a larger effort by the White House to silence critics of the war in Iraq.

"Today's decision is yet another example that this administration simply considers itself above the law," said Clinton of Bush's decision to commute Libby's sentence. "This case arose from the administration's politicization of national security intelligence and its efforts to punish those who spoke out against its policies.

"Four years into the Iraq war, Americans are still living with the consequences of this White House's efforts to quell dissent. This commutation sends the clear signal that in this Administration, cronyism and ideology trump competence and justice."

Fellow 2008 hopeful and former North Carolina Sen. John Edwards also blasted the commuted sentence.

"Only a president clinically incapable of understanding that mistakes have consequences could take the action he did today," Edwards said. "President Bush has just sent exactly the wrong signal to the country and the world. In George Bush's America, it is apparently okay to misuse intelligence for political gain, mislead prosecutors and lie to the FBI.

"George Bush and his cronies think they are above the law and the rest of us live with the consequences. The cause of equal justice in America took a serious blow today."

Senate Majority Leader Harry Reid said: "The President's decision to commute Mr. Libby's sentence is disgraceful. Libby's conviction was the one faint glimmer of accountability for White House efforts to manipulate intelligence and silence critics of the Iraq war. Now, even that small bit of justice has been undone.

"Judge Walton correctly determined that Libby deserved to be imprisoned for lying about a matter of national security," Reid said. "The Constitution gives President Bush the power to commute sentences, but history will judge him harshly for using that power to benefit his own vice president's chief of staff who was convicted of such a serious violation of law."

House Speaker Nancy Pelosi said: "The president's commutation of Scooter Libby's prison sentence does not serve justice, condones criminal conduct, and is a betrayal of trust of the American people.

"The president said he would hold accountable anyone involved in the Valerie Plame leak case. By his action today, the president shows his word is not to be believed," Pelosi said. "He has abandoned all sense of fairness when it comes to justice, he has failed to uphold the rule of law, and he has failed to hold his administration accountable."

Since 'Scooter' obstructed the investigation, the underlying crime went unpunished.

Unfounded hearsay. The reality is the Prosecutor knew EXACTLY who told whom that Plame was an employee of the CIA. He chose to take no action against anyone except Libby and to boost his claim he chose to pretend Libby was hiding information.

If I were Cheney I would have brought charges of Slander against the Prosecutor.

And the "crime" was supposed to be outing a covert agent. Yet Libby was NEVER charged with that. The claim being he was ordered to so by Cheney. Simple enough, BUT if he outed her, why would the Prosecutor need him to confess to that?

We have Care4all telling us over and over that there are numerous credible witnesses that Libby not only told them she worked for the CIA but that she was a COVERT asset. Was the Prosecutor just a bumbling idiot? Maybe it was all a great right wing Conspiracy?

If Libby did not out her why would anyone believe he was covering for Cheney when NO CRIME occurred to cover for? Simple, the Judge allowed the Prosecutor to make unfounded claims with no evidence presented to back them up.

Makes me doubt you actually DID serve on a jury, for if you had, you'd know that the defense doesn't get to pick the jury. Rather the defense along with the prosecution, get to "filter" the jury pool and exclude a certain number of potential jurors. In the end, the jury is generally composed of some of the prosecutor's picks as well as the defense's picks.

All the media attention prior certainly biased the jury pool I feel. This case was played to the media, and IMO meant that Libby couldn't get a fair trial from the outset. The parallel to Nifong's Folly is hazy, but present. The public had already come to its own general conclusions based on what the prosecutors each said in their respective investigations. But while Nifong acted illegally under the color of law, I think Fitzgerald stayed within his legal bounds.

NEW YORK A spokesman for the jury that convicted “Scooter” Lewis of four counts today of perjury and obstruction of justice today in a federal courtroom told reporters immediately afterward that many felt sympathy for Libby and believed he was only the “fall guy.”

Denis Collins said, “We asked ourselves, what is HE doing here? Where is Rove and all these other guys….He was the fall guy.”

He said they believed that Vice President Cheney did “task him to talk to reporters.”

He said, “some jurors said at one point, ‘We wish we weren’t judging Libby…this sucks.” More than once he said many jurors found Libby “sympathetic.”

Asked about Vice President Cheney not testifying, he said, “Having Cheney testifying would have been interesting.” And when the defense opened the trial by suggesting that Libby was scapegoated by the White House, “I thought we might get to see President Bush here.” But said Libby not testifying was not such a big deal since they’d listen to nine hours of tapes of his earlier testimony.

He also said that they found Tim Russert of NBC “very credible” and the defense “badgering” Judy Miller may have hurt them as some jurors developed “sympathy” for her. Even though she admitted having a “bad memory,” the fact that she had notes counted a lot in her favor, he said. Despite the badgering, some jurors thought Miller was “nice.”

Collins, a journalist who has written for The Washington Post and other newspapers – and is author of the 2004 book, “Spying: The Secret History of History”– described the jury’s painstaking deliberations. He said there were several “managerial types” on the jury and they spent many days just assembling post-it notes in some kind or “buildings blocks” fashion. They did not take an immediately straw vote.

Barack Obama today released the following statement on President Bush's decision to commute the sentence of Scooter Libby.

"This decision to commute the sentence of a man who compromised our national security cements the legacy of an Administration characterized by a politics of cynicism and division, one that has consistently placed itself and its ideology above the law. This is exactly the kind of politics we must change so we can begin restoring the American people's faith in a government that puts the country's progress ahead of the bitter partisanship of recent years."

Juror Explains Libby Verdict: They Felt He Was ‘Fall Guy’

NEW YORK A spokesman for the jury that convicted “Scooter” Lewis of four counts today of perjury and obstruction of justice today in a federal courtroom told reporters immediately afterward that many felt sympathy for Libby and believed he was only the “fall guy.”

Denis Collins said, “We asked ourselves, what is HE doing here? Where is Rove and all these other guys….He was the fall guy.”

He said they believed that Vice President Cheney did “task him to talk to reporters.”

He said, “some jurors said at one point, ‘We wish we weren’t judging Libby…this sucks.” More than once he said many jurors found Libby “sympathetic.”

Asked about Vice President Cheney not testifying, he said, “Having Cheney testifying would have been interesting.” And when the defense opened the trial by suggesting that Libby was scapegoated by the White House, “I thought we might get to see President Bush here.” But said Libby not testifying was not such a big deal since they’d listen to nine hours of tapes of his earlier testimony.

He also said that they found Tim Russert of NBC “very credible” and the defense “badgering” Judy Miller may have hurt them as some jurors developed “sympathy” for her. Even though she admitted having a “bad memory,” the fact that she had notes counted a lot in her favor, he said. Despite the badgering, some jurors thought Miller was “nice.”

Collins, a journalist who has written for The Washington Post and other newspapers – and is author of the 2004 book, “Spying: The Secret History of History”– described the jury’s painstaking deliberations. He said there were several “managerial types” on the jury and they spent many days just assembling post-it notes in some kind or “buildings blocks” fashion. They did not take an immediately straw vote.

Libby IS THE FALL GUY for the Vice President's actions and possible crimes.

This is VERY CLEAR by reading all you can on the Libby trial.

This is WHY communting him could be OBSTRUCTION of Justice in and of itself.

It takes balls to commute someone involved in the investigation of a crime with your own office, who was convicted of 4 felonies involved in the coverup of that crime, (obstruction of justice and perjury)!!!!

This is like Nixon or Ford, commuting the staff from his administration for the crimes they committing by lying about the watergate break in and the president's involvement in it..... these guys were charged with obstruction of justice in the watergate investigation as libby was charged with obstruction of justice in the Plame investigation.... Nixon going out nor Ford coming in to office never had the balls to commute someone involve in THEIR OWN WRONG DOINGS....

Bush is pretty BOLD, and defiant of the law when it comes to his "men" imo.

Let it go down in history as another one of his legacies, I guess...:bowdown:
