Brazil Judge Rules NJ Dad Can Get Custody of His Son

People

I'm not insensitive to David Goldman's plight. An amicable divorce settlement complete with visitation agreements etc would be a million times better for everybody.

What I'm trying to convey to you is the following:

The blame for the way Bruna left America falls SQUARELY on the american judicial system that would turn her into a "prisoner of the United States" after the divorce.

Once she was in Rio he should have filed for divorce and demmand his visitation rights just like any other man in the world.

But what he did to Bruna, challenging, disrespecting her custody of her son, trying to repatriate Sean, forcing her to reside in the US, was as morally depraved as what her relatives did to him, after her passing.

Bullshit!!

It's gonna be a cold day in hell before America, Brazil or Mexico extradite the son of a LIVING American/Brazilian or Mexican woman to the country where the kid was born.

Forget political pressure... Forget economic pressure... Forget the Hague Convention...

David Goldman owes 100% of his victory to Bruna's passing.

America and Mexico extradited less than 1% of all the children born to American and Mexican mothers. Brazil not even this...

In cases where you have a living mother the US government usually doesn't even bother to invoke the Hague Convention to request the child's extradiction from the other country involved. The chances of success are next to zero.

Why is the Hague Convention such a MISERABLE FAILURE as far as the extradition of children taken to foreign countries by their mothers is concerned?

The problem is not the Hague Convention in and of itself... The problem is the american, chinese, german etc, etc, laws that forbid foreign born mothers to live in their native countries.

Because, no matter how many International Treaties on child abduction a country signs, THE BASIC, INSTINCTIVE BOND BETWEEN MOTHER AND CHILD and the privileged custody rights that females enjoy as a result of this bond WILL ALWAYS OVERRIDE any law that tries and deny it.

Take it from me... the existence of laws that clash with the basic bond between mother and child, such as the american law that would prevent Bruna from living in Brazil with Sean make sure that International Treaties such as Hague will continue to exist only on paper.

As long as most countries' laws continue to disrespect the right of foreign born mothers to raise their children in their countries of origin the Hague Convention is bound to be solemnly ignored by the signatory countries themselves INCLUDING THE US.
