Bob Barr Files Suit in Texas to Remove McCain, Obama from Ballot

Suit alleges that McCain, Obama knowingly missed filing deadlines

Atlanta, GA - Bob Barr, the Libertarian Party's nominee for president, has filed a lawsuit in Texas demanding Senators John McCain and Barack Obama be removed from the ballot after they missed the official filing deadline.

"The seriousness of this issue is self-evident," the lawsuit states. "The hubris of the major parties has risen to such a level that they do not believe that the election laws of the State of Texas apply to them."

Texas election code §192.031 requires that the "written certification" of the "party's nominees" be delivered "before 5 p.m. of the 70th day before election day." Because neither candidate had been nominated by the official filing deadline, the Barr campaign argues it was impossible for the candidates to file under state law.

"Supreme Court justices should recognize that their responsibility is to apply the law as passed by the Legislature, and the law is clear that the candidates cannot be certified on the ballot if their filings are late," says Drew Shirley, a local attorney for the Barr campaign, who is also a Libertarian candidate for the Texas Supreme Court.

A 2006 Texas Supreme Court decision ruled that state laws "does not allow political parties or candidates to ignore statutory deadlines."

Orrin Grover, attorney for Bob Barr and Wayne Root, said that he believes that the Texas Secretary of State is bound by Texas law to remove the Republican and Democratic nominees from the November ballot. "Either we have rules and deadlines, or we do not," Grover said.

The Chairman of the Texas Libertarian Party, Pat Dixon stated, "Libertarian principles require personal responsibility for your acts and failures. Obama and McCain failed to meet the deadlines. They must follow the law like everyone else."

The petition also alleges that the Democratic Party's late presidential filing falsely claimed under oath that Senator Obama had been nominated hours before the nomination actually occurred.

"The facts of the case are not in dispute," says Russell Verney, manager of the Barr campaign. "Republicans and Democrats missed the deadline, but were still allowed on the ballot. Third parties are not allowed on the ballot for missing deadlines, as was the case for our campaign in West Virginia, yet the Texas secretary of state's office believes Republicans and Democrats to be above the law."

Barr will be holding a press conference this Thursday at the Texas Supreme Court at 11:00 a.m.

Ok. So what does he think he is going to accomplish? If their names get taken off the ballot does he think everyone in Texas is going to vote for him, as a write in? Texan's are smart people ..... some of them - Not GW - they can write in Obama or Mcain just as easy as they write in Barr.

If it's the law - it's the law. It is not going to change anything in who Texans write in their vote for ..... IMO.
 
Barr is actually going to be on the ballot in Texas. As far as write-ins go, neither McCain or Obama would be able to be written in. The date to file for write-in candidacy has also passed. So they would be out period as far as Texas is concerned, if the law is followed of course.

Well I pretty much know that.

My question is, do you think that the law should be followed and Bob Barr be the only candidate on the Texas ballot? Or do you think that they should allow Obama and McCain on anyways?

Thank you very much, Libertarians will need all the luck we can get on this one lol. I personally think that Texas should follow it's own laws and keep Obama and McCain off the ballot. If the situation were reversed I can guarantee that Bob Barr would not be allowed on the ballot, which is actually what happened in West Virginia.

This has teeth. This was a brilliant move. Barr has case law behind him, but he'll still lose.
 
Yes, let's remove the primary candidates from one of the biggest states in the election. I've heard of Dems and Repubs trying to steal elections, but this takes the cake.

I never said wouldn't be a clusterfuck, but any attorney could find the brilliance in this move. If the MSM picks this up and runs, this could be huge for third parties.

So Bob Barr is trying to "steal" the election because the Republicans and Democrats felt they were above filing on time? They're the ones that didn't meet the requirements, they only stole it from themselves.

How are they to file to be on the ticket when they hadn't even been officially nominated by their parties?
 
Just moments ago, Bob Barr and our campaign manager, Russ Verney, stood on the steps of the Supreme Court of Texas to rally a crowd of supporters and answer questions from the media.

Today, we filed an emergency stay to prevent the Texas Secretary of State from printing ballots until after our case was decided.

For a quick recap, earlier this week we filed a lawsuit to remove both John McCain and Barack Obama from the Texas ballot. Texas election code §192.031 requires that the "written certification" of the "party's nominees" be delivered "before 5 p.m. of the 70th day before election day" and both candidates missed that deadline.

When this story first broke, the New York Times , took a jab at us saying that if our campaign prevailed in Texas, the action may, "thoroughly alarm foreign investors."

This morning, political pundits beholden to the status quo got a bit more serious. In a scathing hit piece published by CQ Politics, Craig Crawford wrote that Bob is in Texas "promoting a bogus claim that John McCain and Barack Obama should not be on the state ballot in November."

Sorry, Craig, but you might want to do your homework the next time before you put pen to paper.

When we missed our deadline in West Virginia (a month before Republicans and Democrats were required to file I might add), we were forced off of the ballot. The law is clear and belonging to the Republican or Democrat party does not exempt you from its rule.

Politically biased members of the media are going to move into position and recite talking points that read "BOGUS" each time they are given the opportunity to do so. They'll also be sure to throw in a few other stretches of the imagination or bits of misinformation to smear our candidate and our Libertarian Party.

At this time, we need to simply acknowledge that the attacks will continue. They will be designed to discredit our efforts and demoralize our base.

If you're reading this right now, I doubt you're feeling demoralized. If you're like me, you're ready to do all that you can to fight a clearly corrupt system.

Today our fight is in the Texas legal system.

Let's look at it this way, would that be an acceptable excuse if Bob Barr hadn't been nominated and wasn't on the ballot? No. Ballot laws, no matter how strict and nonsensical they are, must be followed by everyone. Not just third parties.
