SEE: Black Caucus urges Obama to use 14th Amendment debt fix

By Mike Lillis - 07/30/11 10:04 PM ET

“The Democratic members of the Congressional Black Caucus (CBC) urged President Obama on Saturday to sidestep Congress and hike the nation's $14.3 trillion debt limit on his own.

In a letter to the president, the lawmakers argue that he has "both the authority and a moral obligation" to invoke the Constitution's 14th Amendment "to avoid an economic catastrophe of historic proportions."

To argue as the Black Caucus contends is to pretend the Constitution in not crystal clear in its language.

Our Constitution declares that Congress, not the president, shall have power To borrow Money on the credit of the United States!

And with regard to the 14th Amendment, our Constitution once again speaks in crystal clear language, and it informs our Black Caucus that Congress, not the president, shall have power to enforce, by appropriate legislation, the provisions of this article [the 14th amendment].

And so, what the Black Caucus is suggesting is that the President and his Administration engage in a despotic act of tyranny and subvert our Constitution’s “separation of powers” under which the people have wisely and intentionally placed the power of the purse and borrowing in the hands of Congress.

Bottom line is, the Black Caucus is openly and knowingly suggesting a subversive act to override our Constitutionally limited “Republican Form of Government” guaranteed under Article 4, Section 4 of our written Constitution, and they would replace it with what amounts to be a dictatorship.

Those who value their freedom would do well to keep a very close eye on those who suggest such subversive acts.

America we have a problem! We have a group of DOMESTIC ENEMIES who have managed to seize political power and whose mission is in fact to bring “change” to America ___ the dismantling of our military defensive power; the allowance of our borders to be overrun by foreign invaders, the diluting of our election process by allowing ineligible persons to vote; the destruction of our manufacturing capabilities; the transferring of America’s technology to hostile foreign nations; the strangulation of our agricultural industry and ability to produce food under the guise of environmental necessity; the destruction of our nation’s health care delivery system, the interference with our ability to develop our natural resources, namely oil, to fuel our economy; the looting of both our federal treasury and a mandatory retirement pension fund; the brainwashing of our nation’s children in government operated schools; the trashing of our nation’s traditions and moral values; the creation of an iron fisted control unauthorized by our written Constitution over America’s businesses and industries; the devaluation of our nation’s currency, and, the future enslavement of our children and grand children via unbridled debt and inflation, not to mention an iron fisted government which intends to rule their very lives!

obiedoodle hissssself has created an economic catastrophe of fucking historic proportions..

And of course, they are wrong:

The US Supreme Court has ruled that Congress May ***REPUDIATE*** The National Debt and Congress HAS previously repudiated the National debt:

"Mr. Justice McREYNOLDS, dissenting.

Mr. Justice VAN DEVANTER, Mr. Justice SUTHERLAND, Mr. Justice BUTLER, and I conclude that, if given effect, the enactments here challenged will bring about confiscation of property rights and repudiation of national obligations. Acquiescence in the decisions just announced is impossible; the circumstances demand statement of our views. 'To let oneself slide down the easy slope offered by the course of events and to dull one's mind against the extent of the danger, ... that is precisely to fail in one's obligation of responsibility.'

Just men regard repudiation and spoliation of citizens by their sovereign with abhorrence; but we are asked to affirm that the Constitution has granted power to accomplish both. No definite delegation of such a power exists; and we cannot believe the farseeing framers, who labored with hope of establishing justice and securing the blessings of liberty, intended that the expected government should have authority to annihilate its own obligations and destroy the very rights which they were endeavoring to protect. Not only is there no permission for such actions; they are [316-Continued.]"

Yes--Obama can use the 14th amendment--but if he does it will be the final nail in his re-election bid.

it also means that the dissent does not have the force of law and is not enforceable. it is not precedent...

The 14th Amendment does not give the president the power to raise the debt limit. Article 1, Section 8 specifically gives that power to the Congress.

Article 1 - The Legislative Branch
Section 8 - Powers of Congress

The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

To borrow money on the credit of the United States;

To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;

To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States;

To coin Money, regulate the Value thereof, and of foreign Coin, and fix the Standard of Weights and Measures;

To provide for the Punishment of counterfeiting the Securities and current Coin of the United States;
