'Asylum Seekers' Sue Trump For Denying Constitutional Rights?!

That should be thrown out at the lowest level. The president has exclusive authority over awardiing asylum.
The president has almost complete control over refugee and asylum processing. He can suspend it at anytime. Doing so would be a violation of the 1951 Refugee Convention and the 1967 Protocols to which the US is a signer. However, this president has shown clearly that he is willing and able disregard US obligations. This may well be a good political move for the president just before the midterm elections. In the long run it will cast doubt on any agreement the US makes and the US is seeking a number of of important agreements with other countries.
 
Asylum claims made by migrants caught crossing the border illegally would seemingly be summarily denied under Trump's proposal.
I think that's reasonable.
So is ending birthright citizenship for children when both parents are undocumented.

I have a question. The Chinese and Russian women coming here to have their children so they will be US citizens are here legally on a visa, though, so it won't stop the well heeled from taking advantage. Once again, only the poor are going to be punished?
We need to think that through.
It sounds like the Trump proposal would be a clear violation of due process. He would be on stronger legal grounds if he simply closed the border crossing into the US.

Asylum Seeker / Asyum' is a very specifically defined word which the vast majority of these criminals do not meet / qualify as.

- 'Asylum Seekers' must be one of a specific group seeking asylum from one of a few specifically defined things. Being poor as hell and wanting to come to the US does not meet that deco Orion.

- 'Asylum Seekers' must by law file for asylum at embassies or designated ports of entries. These criminals have illegally physically pushed their way past Mexical police/military, invading Mexico, and seek to do the same to the US THEN file for asylum.

The reason why is our 'broke ass' system of 'catch and release' that gives them an 'asylum' court date, releases them, tells them to show back up then, and then we never see them again. That's like catching someone breaking into your house, setting up a trial date for the future, letting them go, and telling the show back up at that future date to decide what will happen to them.... of course you're never going to see them again!

2. United States Constitution provides rights for United States citizens.

That's kind of the reason why it's called the United States Constitution. It does not provide constitutional rights to criminal Invaders...


So basically these criminals are coming all this way, already disrespecting this country by ignoring and having the intent of breaking our laws, and now they want to sue to force us to take them as they invade our country, breaking our existing immigration laws...

You Cannot Apply for Asylum at a U.S. Embassy or Consulate. Unfortunately, U.S. embassies and consulates cannot process requests for this form of protection because, under U.S. law, asylum seekers can apply only if they are physically present in the United States (or at least at a U.S. border or other point of entry).
How to Obtain Protection from a U.S. Embassy or Consulate
You also can not invade a country on the way to the US, reject offers to stay in those countries, invade the US, and THEN request Asylum.

Being from a poor country, wanting a better job / life, wanting to 'win' the US Social Program 'Give-Away' 'Lottery' does not make you a 'Refugee' or an 'Asylum Seeker'.

That's correct. Poverty is not a criteria for granting asylum. An asylum seeker must be in fear of persecution in their home country. Second, the applicant must prove that he or she would be persecuted on account of one of five protected grounds: race, religion, nationality, political opinion, or particular social group.
ICE has procedures for handling asylum seekers that works quite well. When a person is seeking asylum, they are told to approach a US agent at the border and inform the agent that they seek asylum. A trained agent then takes the person aside and ask certain basic questions to determine whether the person appears to meet the minimum qualifications or not. If the person does, they are detained and scheduled for presentation of their petition to an asylum officer. If the asylum officer believes the person meets all requirements, then background checks are ordered and a court date is scheduled before an immigration judge. The petitioner is allowed legal counsel. If a petition is denied, the petitioner has limited rights of appeal. If approved, the petitioner has a final background check and enters the refugee program. About 10% to 20% of the petitions that are presented to the court are approved. Most people that are approved legally entered the US and hired an immigration lawyer to help prepare and present the petition. Very few people that walk up to a border agent and ask for asylum are approved.

Those seeking asylum have the right to due process which simply means the petitioner has to be treated fairly according to established procedures sanctioned by law. This is where most of Trump's efforts to stop asylum applications will run aground. The safest legal way to stop the application process is to close the border crossing into the US.
