Constitutional Grounds for Impeachment

Obama has sworn to "preserve, protect, and defend the Constitution of the United States” I do not believe he has. I think that there are grounds to impeach

The following is from a report written and released by the Judiciary Committee in 1974 in the aftermath of the Watergate crisis.

The framers intended impeachment to be a constitutional safeguard of the public trust, the powers of government conferred upon the President and other civil officers, and the division of powers among the legislative, judicial and executive departments. The framers sought to avoid the creation of a too-powerful executive. “Attempts to subvert the Constitution."
Each of the thirteen American impeachments involved charges of misconduct incompatible with the official position of the officeholder. This conduct falls into three broad categories:
(1) Exceeding the constitutional bounds of the powers of the office in derogation of the powers of another branch of government;
(2) Behaving in a manner grossly incompatible with the proper function and purpose of the office
(3) Employing the power of the office for an improper purpose or gain.


Obama Is Bypassing the Senate
He is “Exceeding the Constitutional Bounds of the power…of another branch of government”

Obama appointing Czars left and right is a violation of the Constitution. Presidents in the past have had Czars but they usually act as advisors and do not make policy. Obama has specifically appointed these people to make policy

Are there grounds to Impeach Obama or am I grasping at straws? Is this worth pursuing?


Once the Republicans can clean house and gain control, I say "Yes We Can".

Unless there is incredibly strong evidence that Obama committed treason or bribery, all an impeachment action will accomplish is to turn him into a martyr.

It's not worth it.
 
To the OP:

Forget about impeachment. There is no point to it. Even if we find that he murdered someone, its going to be difficult to impeach him. And then Joe Biden will become President. And if we think Obama is incompetent...

No the way to deal with the abuses of the current administration is to retake Congress and continue to speak out against it's abuses. If people keep running to impeachment if something an opposing government does something they dont like, we are going to have impeachment talk in every administration until the collapse of our Republic.
 
true. i remember when democratic lawyers like jessjack would go round drumming up a living on people's ignorance, to put it bluntly. it is the conservative's turn with birther and impeachment campaigns filling their coffers with simple american's earnings under the premise that they can affect something like an impeachment.

I just don't understand why left wingers and right wingers toss this term around like it's just another day in the park.

Obama has done some pretty messed up things since he's been in office...he reminds me of Hugo Chavez...but so far he hasn't done anything that rises to the definition of high crimes and misdemeanors....just like Bush NEVER did anything that met that burden.

The only modern impeachment was of Clinton (HOR imeachment, not final sentate trial impeachment) and for that they had to catch him lying under oath.

It was determined by the senate that the charge did not reach "high crimes and misdemeanors" and was not carried out.

You need a hard concrete law violation for impeachment. Anything else is totally political

(yes i know the Clinton Impeachment was political too)

as for clinton...lying to a grand jury...sexual harrasment of a federal employee or sodomy is neither a high crime or misdemeanor....

as for obama...he has done nothing worth of being impeached....

Ford is correct. If the majority of the House is willing to impeach over an issue, it is an impeachable offense. That's how the Constitution works, and that's how impeachment plays out.

Now, if the GOP goes for Impeachment, they'd probably guarantee an Obama second term and a Biden 2 terms. It'd be seen as a VERY politically motivated turn after the Clinton fiasco (which the public at the time did not support) and it would be a major setback for the GOP.
 
I think both parties are always trying to circumvent the Constitution unfortunately. I think the Democrats have taken that mentality to all new lows but it's probably not grounds for impeaching the President. We need to start electing politicians who actually still care about the Constitution. It really is that simple in the end. If you're still waiting for the Socialists/Progressives and Neocons to suddenly start caring about out Constitution,all i can say is don't hold your breath. It is what it is in the end.
