A report commissioned by the Labor Department has found that reverse discrimination is not a significant problem in employment and that a "high proportion" of claims brought by white men are "without merit."

The study of court cases and other employment data, conducted by Rutgers University law professor Alfred W. Blumrosen, is being cited by civil rights activists as raising doubt about one of the central tenets of affirmative action opponents: that policies designed to remedy discrimination against minorities and women have resulted in bias against whites and men.

The analysis was part of a broader review of Labor Department operations under the administration's "reinventing government" initiative, said a department official, who called the report "a draft" that had not yet been reviewed.

The study comes in the middle of an escalating national debate over affirmative action. The administration is undertaking a wide- ranging review of federal affirmative action programs, which Republicans have said need to be revamped or eliminated.

In his report, Blumrosen concludes that there is "no widespread abuse" of affirmative action programs in employment and little justification to dismantle the government's existing structure. He estimates that 5 million minority workers and 6 million women are in "higher occupational classifications" today than they would have been without the initiatives of the 1960s and '70s.

The study was conducted for Labor's Office of Federal Contract Compliance Programs, which enforces regulations that require companies with at least 50 employees and doing at least $50,000 in business with the federal government to prepare a written affirmative action program.

The report by Blumrosen, a specialist in employment discrimination, included these other findings:

Of more than 3,000 reported federal district and appellate court decisions in discrimination cases from mid-1990 to mid-1994, fewer than 100 opinions involved claims of "reverse discrimination." The courts found that many of these cases were without merit. And several, Blumrosen says, were brought by whites or men who were less qualified than the women or minorities who were hired or promoted.

In one case cited by Blumrosen, the court ruled against a white high school principal in Chicago who claimed he was discriminated against when a predominantly black local citizens board voted to fire him. Among the principal's evidence: One black board member smiled at the time of the vote, another shouted "we did it" upon entering the restroom after the vote and another thought there should be black role models in high school.

There were only six cases in which white or male employees were successful in individual claims that they were discriminated against in favor of minorities or women. In cases that more broadly challenged the validity of affirmative action programs, the courts upheld these programs in 12 cases, invalidated or modified them in six cases, and in two cases ruled they had achieved their goals and should be discontinued.

Ralph Neas, executive director of the Leadership Conference on Civil Rights, said Blumrosen's report "further shatters the myth that reverse discrimination is widespread."

But Frederick Lynch, a professor of government at Claremont McKenna College in California, was unconvinced. "A lot of white males, when they feel discrimination, they don't do anything about it," said Lynch, author of the book "Invisible Victims: White Males and the Crisis of Affirmative Action."

Lynch said his research shows that white men "don't go to court." He said they often are afraid of being called racists and whiners and lack the support system of advocacy groups that women and minorities have.
