"Michael Flynn cannot immediately force a federal judge to agree to drop criminal charges against the former national security adviser, a full panel of the U.S. Court of Appeals for the D.C. Circuit court ruled 8-2 on Monday.

The ruling means that U.S. District Judge Emmet Sullivan for the District of Columbia can proceed in examining why the Justice Department took the unprecedented step of dropping its criminal case against Flynn, after Flynn had pleaded guilty and then sought to withdraw his plea.

In its opinion, the D.C. Circuit said that Flynn’s request for an intervention came prematurely, because Sullivan had not yet ruled on the DOJ motion to dismiss Flynn’s case."


Justice still has a chance to prevail in Flynn's case of confessing to a crime. Unless Billy the Bagman is going to retroactively dissolve the appeals court and use a Jedi mind trick to pretend the ruling never happened. Kinda like saying Mueller exonerated Individual 1.

Good that the appeal court agreed 8-2 against the Flynn request and sent the case back to Sullivan. Would not get hope high on this thing. Flynn, for some reason is popular with right wing trumps, so the president will probably step in, pardon and saying "Justice is what I say it is, and don't you forget it"!

Wonder why the fact that the FBI setup Flynn for a "perjury trap", as Comey admitted, doesn't factor in?
Maybe Sullivan can prosecute the case from the bench?
