Now first of all, what this tells you, whether they lose elections, whether they lose votes in state legislatures, it doesn't matter. By hook or by crook, you are not allowed to effectively or successfully challenge the Left. You're just not. Whether it's the environment, whether it's health care, whether it's collective bargaining, you, ladies and gentlemen, are not allowed to reverse course. I don't care how much you pay in taxes, how miserable the health care system's going to be, I don't care how many illegal aliens are crossing into your town, it doesn't matter.

You have no say. Now you can go through the motions according to the Left, you can go through the motions and vote. And if the outcome is one that they like, they'll let it stand. If they can't get what they want by leaving town, they'll go to a liberal activist judge. And if they couldn't get what they wanted from her, well they'll go to the Secretary of State who will slow down the process of actually implementing the law so that the Left-wing locals can cut their deals with the government unions real fast before the law takes effect. If that doesn't work, well, they'll use the bureaucracy to punish you. This is what I mean - it's a soft tyranny. Absolutely a soft tyranny.

At the risk of detonating this grain elevator... let's light a match and take into account that those who wish to keep many of these 'for the children' programs are often the same ones for aborting 'unwanted' children.

I detect a certain amount of inherent hypocrisy in this regard.

I'm not saying this about you Samson... but I've seen others I know of that opinion say both. Save the children, kill the fetus people I find hard to follow.

For example, my declaratory judgment, of course, only applies to the parties to this litigation. [...] In addition, many of the plaintiff states have publicly represented that they will immediately halt implementation of the Act in light of my declaratory judgment, while at least eight plaintiff states (as identified by the defendants in their motion and reply) have suggested that, in an abundance of caution, they will not stop implementing the Act pending appeal.​

In other words, the decision of whether to implement or not in those states where the ruling would actually have any effect (only those party to the litigation) was made primarily by the states themselves.

What exactly do you think HHS should have stopped doing? Perhaps halting funding to high-risk pools in those particular states and ending any enforcement of the New Patients' Bill of Rights in those states. But the primary implementation activities they're engaged in--high-level activities like writing guidance, and providing technical assistance and funding to state governments--didn't and shouldn't have stopped because they're still responsible for ensuring the law is implemented in the states that weren't party to the litigation. The real on-the-ground, nuts-and-bolts stuff is state activity and those states that were parties to that litigation but continued to implement after Vinson's ruling chose to continue implementing voluntarily.

Absolutely it is disturbing and should be disturbing to all freedom loving people everywhere. In Wisconsin, in Arizona, and in various other states, we are seeing the courts stop the will of the lawmakers again and again, not because the law would cause irrevocable harm, but because of ideological perspective.

You're right. For that the real cuts have to happen in social spending. I'm ecstatic that will be happening soon. Privatization of social security, ending the Great Society and New Deal failures... Eliminating government duplication of effort in unconstitutional agencies and services.

The future is bright after the end of the me generation's control... assuming they just don't slap the 'self destruct' before they pass.
 
Im not sure how much of an opinion there is, she intervened when the standard has always been the assumption by other branches of governemnt that the laws were legally created by legislation, then challenged after the effect by someone with standing .
Isnt that the normal process should a legal challenge be necessary ?

This judge had no business issuing an injunction on a law that was completed Legally. I see this a s the Judiciary interfering where it doesn't belong.

What will be next? This judge issuing an order that the LAW be repealed?
