The Justice Department announced Friday that it is closing its investigation of Andrew McCabe, the FBI’s former deputy director, over his false statements to investigators probing an unauthorized leak that McCabe had orchestrated. McCabe was fired in March 2018, shortly after a blistering Justice Department inspector general (IG) report concluded that he repeatedly and blatantly lied — or, as the Bureau lexicon puts it, “lacked candor” — when questioned, including under oath.

Why not indict McCabe on felony false-statements charges? That is the question being pressed by incensed Trump supporters. After all, the constitutional guarantee of equal justice under the law is supposed to mean that McCabe gets the same quality of justice afforded to the sad sacks pursued with unseemly zeal by McCabe’s FBI and Robert Mueller’s prosecutors.

George Papadopoulos was convicted of making a trivial false statement about the date of a meeting. Roger Stone was convicted of obstruction long after the special counsel knew there was no Trump–Russia conspiracy, even though his meanderings did not impede the investigation in any meaningful way. And in the case of Michael Flynn’s false-statements conviction, as McCabe himself acknowledged to the House Intelligence Committee, even the agents who interviewed him did not believe he intentionally misled them.

The only LOGICAL ANSWER is McCabe made a deal. It looks like the DOJ wants Brennan, Clapper and Comey. Strozk and Page will also see indictments and the star witnesses will be the Ohr’s.....Good old Andy can tie them all together....or spend a few years in jail!!!

Could be. But, just as likely, they did not have enough to get past a grand jury, much less a jury of his peers and a judge. No need to prosecute unless you have a chance of winning. How would you like to be a career government lawyer in a high profile political show trial, and lose big, even though you had the power of the entire justice department and the presidency behind you. Sounds like a good way to become a process server.

If he’s under indictment he has no credibility as a witness in deeper investigations. My guess is Brennan is the first to go down. Q says the first indictment will shock the world and will set the standard for future action. We all know they have the goods on McCabe so the only thing that makes sense is he’s cooperating, in which case tagging him up on a lying and leaking charge does very little for overall justice and ruins his credibility as a witness for public optics.
 
"At this time" was the way the DOJ put it. Doesn't mean they can't indict and prosecute him for this and other things later. Double jeopardy is not in play.

I think they probably made the decision that a conviction was doubtful given these two factors. Trump's tweet storm would have also been put before the ant-Trump Jury likely making conviction impossible, this may have been what triggered Barr's comments that occurred at the same time.

I suspect the decision was made not to indict McCabe because there is so much evidence of malfeasance in Obama's DoJ, that if everyone who made a false statement or concealed evidence were indicted, there would be no one to answer the phones.

So the DOJ carried on a ridiculously long investigation (2 years) which could have been done in weeks and found not enough evidence to press charges... McCabe is innocent... The DOJ has been severely criticised as acting like a political wing of the Trump Administration.

If ye weren't all so blinded by partisan politics you would see this. Obama never directed anyone to investigate his political foes or people he had axe to grind with... The people in the Trump Campaign were picked up in an investigation into Russian Meddling in the election.

What Trump supporters are asking is for the next Democratic President to have all GOP under investigation. Trump and GOP have cleared this. You can even ask other countries to help.
