Wouldn't it be funny if in the near future we saw the Hamas leadership along with Netanyahu and his gang were all sitting in the same cells playing Pinochle blaming each other for their collective fate?

Clearly both gangs committed war crimes in the last Gaza War, all caught on film for he world to witness. It's not so far-fetched...

Shurat Hadin announced the move a day before the Palestinians officially become members of the International Crime Court, where they hope to see Israeli officials prosecuted for similar offences.

"We can't sit idly by. We need to fight back," said Nitsana Darshan-Leitner, the director of the non-governmental organisation
 
In order to be bound by the rulings of the ICC, one must first subscribe to the jurisdiction of the ICC.

Neither the United States nor Israel are presently subscribed to that jurisdiction.

Good luck, generating anything but toilet paper out of that venue, as it pertains to either the US or Israel.

Frankly, any writ coming out of there - once extensively copied - will do nothing more than to increase the Strategic Toilet Paper Reserve of Israel.

They'll wipe their asses with it.

And laugh while they're doing it.

Besides... there's a lot of Euro-Trash willing to kowtow to the Arabs in order to keep the oil flowing.

Hardly the most objective venue on the face of the planet.

They are not going through the ICC are they, but going through the US court system. This means that any hamas official who sets foot in the US will face arrest and possible action to recover damages. It is the same tactic that the P.A. tried some years back in the UK, and now the UK has changed the laws so that Israelis no longer face arrest when travelling to the UK. The P.A. has to provide UK private police to issue the arrest warrants, and they don't come cheap with the amount of personal insurance they have to pay. Guess the P.A. is losing again, how many times have they lost up to now ?

Nothing to do with the ICC but it is still International law and can be exercised in most countries. Very soon the P.A. wont be able to send anyone to the U.N. without them getting arrested.

Nobody ever accused the Palestinians of an over-abundance of intelligence, in matters of negotiation, and policy.

Nature abhors a vacuum.

Most especially one that lies between the ears - as it does with the leadership of Hamas, Fatah, et al.

Nature has de-selected them.

One of these days, in the not too distant future, this Collective Walking Corpse will figure it out, and lie down, and be still.

As more and more Gazans and West Bankers figure it out, and pack up, and leave for greener and more peaceful pastures.

Interesting point. One judge in the US had to recuse himself from a Palestinian case because he had investments in Israel.

So good luck finding a judge without a conflict of interest like a family member who has Israeli citizenship, a son who served in the IDF, investments, or any other connection with Israel.

Not as big a problem as you seem to think, the numbers of similar cases heard in the US in recent years as the people bringing the cases are American citizens and not Israeli's.

Guess you didn't read the OP very carefully and thought it was the Jews bringing the cases.

Abu Mazen Got the approval to join the court from Hamas and the other factions. Evidently they think they have a good defense.

It is now April 1st and the ICC have released the report that shows that hamas is gulty of war crimes, so Abu Mazen withdraws his complaint.

Did but not any more after the report this week. That is when abbas withdrerw the complaint.

If, during the course of a Preliminary Investigation (analyzing alleged crimes on the territories Palestine), evidence discovered that would lead the Prosecutor to believe probable cause exists under the statutory legal criteria of the ICC, the Prosecutor will opening an investigation. It is not (at least it is not suppose to be) a one sided examination into the activities of Israel.

Gathering of relevant information from reliable sources, from all sides and from anyone who chooses to provide such information and rigorous analysis and assessment of such information are key activities during this stage. The analyses is conducted independently and impartially on the basis of legal criteria specified in the Statute.

There are no timelines provided in the Rome Statute for a decision on a preliminary examination.

I'm not sure this is going to turn-out well for either side.

It will be interesting to see what the ICC has to say.
