JUNEAU, Alaska (AP) — A judge has ruled against Republican Joe Miller's lawsuit challenging how Alaska counted write-in votes for rival Lisa Murkowski in their U.S. Senate race.

Judge William Carey's ruling Friday is virtually certain to be appealed to the state Supreme Court. The judge said his decision wouldn't take effect until Tuesday to give Miller time to appeal.

Miller's attorney had asked Carey to strictly enforce a state law calling for write-in ballots to have the oval filled in, and either the candidate's last name or the name as it appears on the declaration of candidacy written in.

Murkowski ran an unprecedented write-in campaign after losing the GOP primary to the tea party favorite.

Unofficial results show she won. But Miller complained that the state shouldn't have used discretion in determining voter intent in tallying ballots for Murkowski.

"The definition of 'appears' in this context does not require perfection or precision, but rather a close, apparent approximation known to the viewer upon first look. This seems to the court the far more reasonable interpretation of the term than the rigid meaning attributed to it by (Miller)," the judge wrote in his ruling. "If exact spellings were intended by the legislature, even with respect to the most difficult names, the legislature could have and would have said so."

This is about the LAW. The legislature passed a law that STATED the last name must be used on the write in form and that the oval by the write in spot must be filled in. If either condition is not met it is an INVALID vote and can NOT legally be counted. Further it is a Federal election for US State Senator and Federal law states that the law governing a State run election can NOT be amended or changed during an election cycle.

If the Alaska Supreme Court refuses to follow the law Miller has a legal right to take it to Federal Court. Pretty simple concept.

It is also the law in most places to not jaywalk, so should we have the cops standing around on street corners at 3 o'clock in the morning giving tickets to people who walk across the street on a green light even though there are no cars around? It is the law, after all.
