I would say the litmus test would be actual damage to normal organs. And, gender appropriate. So if you're a dude and your dick gets caught in the lawn mower, then yeah, insurance pays for a new dick or whatever. If you're a lady and you have breast cancer, insurance pays to improve your self esteem with implants, but not a penis, because you're a woman. Seems pretty simple.

Insurers and doctors are shying away from the medical malpractice they had NO BUSINESS being involved with doing in the first place. The ACLU has its hands full since in order to win, they'll have to actually prove that these procedures are medically necessary and effect the changes they say they do. Since no doctor will ever take the stand and say "yes a man can become a woman" or the opposite, the ACLU will lose this case. All it will take is for the judges to review the waiver forms that doctors make patients sign before the amputation of healthy vital organs begins.
