Lee committed Treason. That's according to the Constitution of the United States.
I'll hazard to say that makes him a traitor.
Unfortunately it was the U.S. government that began making war against the states. It can't be treason for them defending themselves.
"The States" were in violation of the Constitution.
Section 10 - Powers prohibited of States
No State shall enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts, or grant any Title of Nobility.
And those States fired the first shots.
The U.S. Constitution didn't apply to states no longer under its authority, so they were free to form any confederation they wished. Also, the Constitution does not deny them the power to secede so under the 10th Amendment they have that authority.
As for firing the first shots, it's clear that Lincoln forced their hand so that he could have his war. Not to mention nobody was killed at Fort Sumter and the Union troops were sent home where they belong because the Confederacy was not at war with the Union.
