More than eight out of ten illegal aliens apprehended by the United States Border Patrol are not prosecuted. They are simply let go.
These shocking (well, not so shocking) statistics come from Congressman John Culberson, who submitted these statistics for the record during a House subcommittee meeting on homeland security. Culberson stated, quite rationally, that it is going to be impossible to stop illegal immigration, drug smuggling, and other nefarious activities if those involved face no criminal penalties. He urged that Operation Streamline, which fast tacks prosecutions and deportations of illegal immigrants, should be applied across the entire border.
Of course, the head of the Customs and Border Protection agency disagreed, stating that there were "a lot of variables," including the inability of judicial systems along the border to handle any increased load in prosecutions. How vastly expensive court hearings are required for non-citizens that are caught trying to cross the border was not explained. Why we even bother having a Border Patrol if they aren't allowed to do their job was also not explained.

The cost of prosecuting them would be horrendous. Shove 'em back over the border. Of course they will try again, but it will cost THEM to hire coyotes for that 2nd, 3rd, 4th time.

Unless they are busted smuggling drugs with them. Then we need to eat the cost and prosecute. However, our jails would be like a motel compared to the jails in their own country so are we doing them a favor by tossing them in one of ours?

Monday, March 28, 2011 - President Barack Obama on Monday told a student who has received a deportation notice that he does not want to deport her -- he wants people like her to succeed. The exchange happened during a town hall event sponsored by the Spanish-language television network Univision at a Washington, D.C., school. A student, who appeared via Skype, asked: “My question for the president is, why [is the government] saying that deportations have stopped -- or the detention of many students like me, why is it that we are still receiving deportation letters like this one?”

Obama answered, “We have redesigned our enforcement practices under the law to make sure that we’re focusing primarily on criminals, and so our deportation of criminals are up about 70 percent. Our deportation of non-criminals are down, and that’s because we want to focus our resources on those folks who are destructive to the community. “And for a young person like that young woman that we just spoke to who’s going to school, doing all the right things, we want them to succeed," Obama said. "I have been such a strong proponent of the DREAM Act--why I reiterated during my State of the Union speech that we need to pass the DREAM Act," said Obama. “We came close in the December. It almost happened.”

The president later added, “America is a nation of laws, which means I, as the president, am obligated to enforce the law.” After the president addressed the illegal-alien student’s question, the moderator of the event asked Obama, “Mr. President, my question will be as follows: With an executive order, could you be able to stop deportation of the students?” Obama said, “There are enough laws on the books by Congress that are very clear in terms of how we have to enforce our immigration system that for me to simply, through executive order, ignore those congressional mandates, would not conform with my appropriate role as president.”

“That does not mean, though, that we can’t make decisions, for example, to emphasize enforcement on those who’ve engaged in criminal activity,” said Obama. “It also doesn’t mean that we can’t strongly advocate and propose legislation that would change the law in order to make it more fair, more just, and ultimately would help young people who are here and trying to do the right thing –and those talents we want to embrace in order to succeed as a country.” The town hall took place at the Bell Multicultural High School in Washington, D.C. Attendees of the town hall included students and parents.

The DREAM (Development, Relief and Education for Alien Minors) Act, which failed to pass during the lame-duck session of Congress in 2010, would have allowed young illegal immigrants who have been in the states for at least five years to acquire legal status if they pass background checks, attend college or serve in the military for at least two years. The president also called for “comprehensive immigration reform” and added that the U.S. immigration system is broken. “We have to have secure borders, we have to make sure that businesses are not exploiting undocumented workers, but we have to have a pathway to citizenship for those who are just looking for a better life and contributing to our country and I’ll continue to fight for them,” said Obama.

I live in Texas... this is'nt news to me.
 
The cost of prosecuting them would be horrendous. Shove 'em back over the border. Of course they will try again, but it will cost THEM to hire coyotes for that 2nd, 3rd, 4th time.

In the article it mention jail for up to 180 days. The average cost of keeping a person in jail in the US is $108/day. 180days = $19,440 plus the cost the cost of prosecution.
 
This whole thing stinks. Illegals are ILLEGAL, meaning it's against the law. We don't need to "process them" and deport them. We just need to deport them. They should not be here. Their immigration policies are a lot more stringent than ours, yet they come here and complain because the Democrats and Liberals listen, and take advantage of the situation. Democrats are tired of being accused of dead people voting for them (even though it's true), along with dogs, cats, fish, and various other "voters" not allowed to vote. I'm not a racist for wanting illegal immigrants to be forced to obey immigration laws, and the immigration laws put in place are not racist either. It's just fact. I don't care what color the illegal immigrant is. Another messed up thing is that it's a slap in the face to immigrants that have done everything required to be a legal citizen. They took the time, and spent the money, and learned the english language in order to be a part of our country, and these illegal immigrants don't and won't. In my opinion, the immigration laws need to be enforced. I know for a fact (at least in the states I've lived in) that people are supposed to carry identification on them at all times outside of their homes, and if they are caught without it, we either get a fine or go to jail. If that is okay for an American citizen, how is it racist to make immigrants carry proof they are here legally? You would have to do that in any other country you went to. You go to a foreign country, you MUST have your passport/visa with you at all times outdoors. So every other country on the face of the planet is racist as well? Give me a break. I don't pay 40k in taxes a year so that some illegal immigrant can go to school here. Stay in your country and apply for a student visa like everyone else. When your business here is done, LEAVE. You want better opportunity? Make it in your own country, not by exploiting the power hungry in ours. You want a better life for your family? Get your life straight before having a family. People's priorities are screwed. The U.S. has it's own issues to deal with first and foremost before "helping" anyone else. Most of our schools suck now, and it's because of this new breed of "no consequences, no accountability" teachers. Our budget and economy is in the crapper because of the Federal Reserve Notes that are all worth less than face value, as opposed to United States Notes that are backed by silver and hold no debt, along with backwards programs meant to coddle certain people...you know what, I'm going to stop here because I am going into another subject. I am going to post the rest there. Point is, we are the only ones with the power t o stop illegal immigration. It is a problem, and it will either be solved, or Mexico will be Canada's new next door neighbor.

But because a Senator said that "8 of 10 Illegals Caught Are Not Prosecuted" we accept it as fact even though Immigration disagreed at the hearing???
Don't misunderstand me.
I believe in prosecution of any and every crime. Including illegal immigration.
I just wanna know where the figures are coming from.

Federal officials say the decrease is due to the right mix of &#8220;personnel, technology and infrastructure&#8221; accomplished by deploying 76 percent more U.S. Customs and Border Protection agents to the area.

‘Major’ Criminals Trying to Enter U.S. Through Legal Entry Points Have 60-70 Percent Chance of Avoiding Arrest
Wednesday, April 06, 2011 Washington (CNSNews.com) – Drug traffickers and other criminals seeking to enter the U.S. through a Customs and Border Protection-controlled port of entry (POE) to commit a “major violation” have approximately a 70 percent chance of not being apprehended, a U.S. House subcommittee hearing heard this week.
Yet at points along the southwest border in between the POEs, the CBP is able to catch criminals 70 percent of the time, the hearing was told. Chairwoman of the Homeland Security subcommittee on border and maritime security, Rep. Candice Miller (R-Mich.), told Tuesday’s hearing it was a matter of concern that the CBP “apprehends only 30 to 40 percent of major violators such as drug traffickers at the air ports of entry and less than 30 percent at the land POEs.” She said the figures came from the Department of Homeland Security (DHS) congressional budget justification for fiscal year 2010 (PDF 165.6 MB). The Customs and Border Protection agency (CBP) is part of the DHS.

In his testimony, Mayor Richard Cortez of the City of McAllen in Texas noted the disparity between apprehension rates at the controlled crossing points, and elsewhere along the border. “Between the ports, we catch the criminals 70 percent of the time. At the ports, we catch them less than 30 percent,” he said. “That is an imbalance Congress must help to correct.” Cortez told CNSNews.com his figures came from the CBP. Both Miller and Cortez referred to the Department of Justice assertion that 90 percent all illicit drugs smuggled into the U.S. come through land POEs.

Asked by Miller about his manpower needs in order to improve security at POEs, CBP Assistant Commissioner Thomas Winkowski said he did not have figures, but was working on it. Richard Stana, director of homeland security and justice issues at the Government Accountability Office, estimates that 6,000 additional inspectors and more than $5 billion for facilities are needed for effective security at POEs. Miller criticized DHS for not including the apprehension rate of “major” criminals at the U.S. ports of entry in its latest budget justification.
