District Court Judge Dabney Friedrich rejected an attempt to have special counsel Robert Mueller removed from the Russia investigation.

Attorneys for Russian oligarch-owned Concord Management and Consulting LLC, which has been indicted by Mueller, recently argued in court that the special counsel’s appointment is unconstitutional because he was not appointed by the president or attorney general.


But in a 41-page ruling released on Monday, Dabney rejected the defendant’s argument.

Point-by-point, Dabney dismantled Concord Management’s attack on Mueller. According to the judge, Deputy Attorney General Rod Rosenstein acted properly when he appointed Mueller because Attorney General Jeff Sessions had recused himself from the investigation.

The decision makes Dabney, who was appointed by President Donald Trump, the fourth judge to uphold Mueller’s appointment.

District Court Judges T.S. Elliot, Amy Berman Jackson and Beryl A. Howell have all previously rejected attempts to undermine Mueller’s investigative powers.

The fact that this "Russian collusion" investigation has only resulted in Manafort being indicted for wire fraud from something he did 13 years ago and he was campaign manager for Trump for only 2 months shows how desperate they are.

Judges have proven themselves to be morons in the past. The supreme court will fix all this shit, hopefully.

But lets be very clear, this was NOT Trump removing him. Trump has the power to remove him with the stroke of a pen. This was a private party filing this claim.

Yes it is. Trump appointed him. So Trump can fire him. He can fire him for the raid on Cohen's office looking for proof of paying off a hooker, which was far beyond the scope of the investigation which was Russia Trump collusion. Trump serves as the top federal law enforcement officer. If he disapproves of the execution of the law by subordinate Justice Department officers, he can remove them. Presidents can not only direct all federal prosecutions, as they have from the days of George Washington and Thomas Jefferson, they also can drop cases for wasting resources.

Perspective | Yes, Trump can fire Mueller. But a normal president would know not to try it.

Nope he'd be well within his constitutional right to do so. Nothing to end his presidency over. He could fire him for no reason at all, but the fact that he was appointed to investigate Trump Russia collusion and he had his lawyers office raided by force to look for evidence of paying off a hooker shows he overstepped his bounds and would be justification for firing him immediately.

If Trump fires Mueller, he is committing an act of obstruction of justice, which he has done several times before.

Mainstream GOP leaders have told him (including McConnell and Ryan) that is Presidency is over if he does that.
