URBANA — Donovan Nicholas — a slightly-built, 14-year-old eighth-grader who stands not much over five feet tall — laid in wait at his rural Champaign County home for his father’s longtime girlfriend Thursday night, lured her in and then killed her as he had planned, a county prosecutor said Friday.

Prosecutor Kevin Talebi wouldn’t say, specifically, how 40-year-old Heidi Fay Taylor died, but he did say that Nicholas used multiple weapons, “including a knife and a gun.”

Talebi filed charges of aggravated murder and murder against Nicholas in Champaign County Juvenile Court Friday. At the teen’s initial court hearing, he wore the standard uniform of the Central Ohio Youth Center in Marysville, but otherwise he appeared at ease as he answered the questions from Judge Lori Reisinger.
....Defense attorney Darrell Heckman said in court that Nicholas has never been in trouble before. He asked that the teen be released to his father and ordered to wear a monitor while on house arrest.

“He is a child,” Heckman said. “To say that he is a flight risk is, quite frankly, silly.”

The judge disagreed; she sent Nicholas back to detention and ordered a psychological evaluation.

Talebi said he has not yet decided whether he will seek to try Nicholas as an adult because the case is still so fresh.

On house arrest with a monitor while they are considering charging him as an adult? I think not.
