Because he has a previous record the charge was increased from petty theft to a felony. So I guess the state and the taxpayers now have to pay thousands of dollars to house and feed him and to pay for his defense over a cup of soda. Maybe he wanted to go to jail.

According to the arrest report, the manager told sheriff’s deputies that Abaire entered the store and asked for a glass of water around 10 p.m. The employee reportedly told him the cup was for water.

However, Abaire went on to fill it with soda at a fountain machine and sat outside the restaurant. The manager then asked Abaire to pay $1 for the soda. Unfortunately, he refused and would not leave the premises. Abaire then left the establishment when the manager lectured him.

Abaire currently faces his $1 felony case and remains in Collier County jail with bond set at $6,500.
